JACKSONVILLE, Fla. -- Casey Anthony was acquitted last week in state court of killing her 2-year-old daughter, Caylee.
Now, a new website, change.org, is petitioning to have Anthony tried for the same crimes, but this time in federal court. It's called the dual sovereignty rule.
"The double jeopardy clause has been interpreted to allow two prosecutions as long as they're by different sovereigns," said B.J. Priester, a professor at Florida Coastal School of Law.

I thought her mother was taking care of or had custody. All we get here are bits and pieces of US stories.
The Army Green Beret doctor..Captain Jeffery McDonald was tried twice.

“There was plenty of evidence.”
Yes, I understand you sat through every hour of the trial. You heard all of the evidence so what’s wrong with these stupid jurors... /S
Aye,there's the rub.
Sorry. But no dice.
Yes, it is true that Double Jeopardy applies only to being tried twice in the same sovereign jurisdiction, and yes you can be tried for the same crime in every sovereign jurisdiction your crime offended. Thus if, say you kidnap a woman in Texas and murder her in TN, you can be tried with kidnapping and Murder in both Texas, where the crime began, and TN where the Crime ended. Also, because you crossed state lines, The Federal court also has jurisdiction over the crime and you can be tired there as well.
There is no interstate component to this murder, therefore only a single sovereign to offend- and thus double jeopardy is a bar to any further prosecution
and frankly we want it that way. Yes, This one person walks free, but expanding the reach of the federal government, particularly in the realm of criminal law, is a very bad idea.
LOL - the Commerce Clause, of course!
Don't you know? EVERYTHING IN LIFE is in the Commerce Clause.
They have fallen prey to the Nancy Grace Cult.
The feds have repeatedly used public outrage or fear to gain greater control.
I don’t think she even spoke with the FBI. I cannot think of what federal crimes she might have committed.
I want her to pay as much as anyone else, but I do not like the Feds being backup for the state courts.
That only worked in the Rodney king case because the crime charged was “conspiracy to violate civil rights under the color of law” In other words it became a crime because they had badges, it was a law to prevent “Mississippi Burning” type situations
I am sure you have not.
“I thought her mother was taking care of or had custody.”
I didn’t follow it that closely unlike indylindy. He was in the courtroom every day ya know. I assumed the mother of the child had custody. If the grandmother had custody, why didn’t she report her missing.
You all on the “don’t criticize the jury” kick need to stand down. It’s completely American to be skeptical and to hold idiocy responsible for it’s actions. I’d be willing to bet that John Adams and his jury had their share of criticism over his win in the Boston Massacre verdict.
BTW, there were a lot of white sheeted Democrats that went free in trials over the years, too. Does the “sanctity of the jury” mean we can’t criticize them either?
First of all, by your own so-called logic, since you certainly did not sit through every hour of the trial and hear all the evidence, you have no justification to have an opinion in the matter, pro or con. So you shouldn't be talking at all.
Second of all, your argument (which is actually a bumper-sticker meme) is, in fact, merely an abuse of critical thinking. It isn't every hour at the trial, all the transcripts, and being there in person, in the jury room, that matters. It is the review of established evidence that is contradictory, and for which no reasonable explanation has been supplied, but which can easily establish knowledge, manslaughter and even murder, which has been left unanswered by a manipulation of the court process, which millions of people are looking at here. No one denies that this is how our legal process works. No on except apologist shills, however, demand that people dumb themselves down to believe that justice was served, and that their own common sense and clear thinking is somehow faulty because they dare see the hypocrisy of the non-answers and lies they've been fed.
In other words, go ahead and put your money where your meme is, and hire Casey to babysit YOUR kids - but leave the rest of sane America out of it.
You already forgot about the double trial for the Rodney King cops?
Unbunch your panties. I think you'll find very few freepers agreeing with the premise of this article.
She may have used illegal light bulbs or 3 gallon flush tiolets or a million other federal laws. Trust me, if they want to find something, they can find some law each and everyone of us has broken.
Consensus down here says she did it. I thought she was just having her over for a few weeks then to be returned to the grand mother. The GM kept asking, or her mother kept asking, where Caylee was. That’s when all the lying started.
