JACKSONVILLE, Fla. -- Casey Anthony was acquitted last week in state court of killing her 2-year-old daughter, Caylee.
Now, a new website, change.org, is petitioning to have Anthony tried for the same crimes, but this time in federal court. It's called the dual sovereignty rule.
"The double jeopardy clause has been interpreted to allow two prosecutions as long as they're by different sovereigns," said B.J. Priester, a professor at Florida Coastal School of Law.

They can try her for violatimg Caly’s civil rights.Probably the only thing I can think of.The Feds have done that in the past where the Government failed to get a conviction on a murder charge.

I’m not so sure it was a travesty... This was no hung jury, it was an acquittal. The 12 jurors sat through the trial, heard all of the evidence and ALL said she was not guilty.
They must not have had any evidence, in which case the verdict was proper. Certainly she was guilty in her “trial in the media”, but we know what legal and ethical standards they have.
What would have been a travesty would be convicting her without evidence...
It shouldn’t be illegal to lie to cops unless it’s illegal for them to lie to suspects.
This is called Double Jeopardy! You can’t try a person twice for the same crime. This is like a do over!

Looks like there might be witness tampering. Could the original trial be vacated and a new trial ordered? Inquiring minds want to know.

To be brought by who, exactly? Kaylee's next of kin, Casey, would presumably be profoundly uninterested in such a filing. The grandparents, maybe, but do they want to invest the millions required to take such a suit forward against a defendant who is not exactly rolling in the green stuff - yet. Noone else has standing to sue, as far as I know
If there is ever a big book deal on the table, such a suit might make sense.
If I remember correctly they were involved.
We all agree that Casey and her parents know what happened.
She was acquitted lawfully, and despite the fact I believe
the jury was a bunch of idiots, there’s nothing else to be done. Casey may have gotten her justice; Caylee will have to wait for God’s judgement, because there won’t be any justice for her on Earth.

I don’t like the verdict but a jury doesn’t have to convict even if they have video of the act.
There was plenty of evidence. I have no problem if people choose not to do anything but protect the jury, but it would really be better to not try to argue innocence for Casey in this case. She is anything but.
I think the Florida jury screwed up in not convicting her for child neglect, which is really more of a “are you kidding me?” moment for me than the acquittals on the more serious charges. That said, I think federal civil-rights prosecutions ought to be reserved, if used at all, for cases where the state trial genuinely was a flat-out, no-BS sham, not as an end run around the Fifth Amendment because you didn’t like the state trial verdict and/or the jurors were idiots. It was a bad idea for King and Powell (the Rodney King cops) and as much as I dislike the verdict in the Anthony case, I think it’d be a bad idea here.
Unfortunately the result of this trial is bringing up exactly what was expected.... Outrage, but it’s pointed in the wrong direction and as a result everyone wants more laws, “Caylee’s Law” i.e. not reporting children missing within 24hrs, probably will be a federal crime punishable by death if they can get it on the books in the next few months. Next will be a duct tape law where you need a background check to buy duck tape and the list goes on.
Over reaction to anything results in bad decisions being made.
Bottom line is the prosecutor’s fxcked up royally.. that’s who folks should be pissed at.
We don’t need more BS laws.
Section 1983 only applies to actions under color of law (e.g., actions taken by public officials/officers).
