Appeals Court in Ohio Upholds Health Law (Requirement to buy Health Insurance is Constitutional)

A federal appeals court in Cincinnati on Wednesday upheld the health-care law passed by Congress last year, saying the law's requirement for most Americans to carry insurance or pay a penalty is constitutional.

The vote was 2-1 on the three-judge panel on the key question of whether the insurance requirement exceeded Congress's powers under the Commerce Clause of the U.S. Constitution. The majority concluded that it did not.

Your misreading of history, selective memory and refusal to acknowledge achievements and only see shortcomings in the body politic are indicative of one with little real world experience and mere “ivory tower” ideology.

Folks, we really need to stop our “all or nothing” lockstep mentality. William Buckley realized conservatism was more than an academic tour de force: it is ALSO the belief system of the “everyday” man, whether they realize it or not. And there ARE different degrees of conservatism. Not all of us are going to agree 100% of the time. We ought to be ashamed for even thinking that would be the case.

Consider the lesson of the Framers of our Constitution: you had ardent federalists like Hamilton and you had die-hard state-rights men like Charles Pickney. But they all agreed the Articles of Confederation weren’t working...and that the nation as a whole was in danger if the current path continued.

We are in the same dire straits today, my friends. We are facing a tyranny of government—homegrown or foreign—that will enslave ALL of us regardless of race, religion, or right-wing purity. Disagree if you must with each other, but never lose sight of the real enemy. Or our Republic may not endure.

This isn’t the kind of case in which Kennedy would vote with the liberals. It’s usually the social issues like abortion and the death penalty where Kennedy sides with the liberals. There’s been at least two cases where Kennedy voted to strike down federal laws that violated the commerce clause, and if he voted to strike down those laws I don’t see any way that he’ll vote to uphold Obamacare.

I pray you're right about that.

“SCOTUS checks congress and the Executive branches. That is supposed to be their job. SOCTUS DOES have the power to decide whether legislation is constitutional or not. Look up “Judicial Right of Review” something that has been done by SCOTUS for well over 100 years.

As for the rest, the constitution has been ignored for FAR too long. Thats why we have to get off our comfy butts and go work to elect representatives that will roll back these unconstitutional measures. Otherwise the only remedy left to us is to replace this form of government.”

You must be dilutional if you think we can or ever will uphold the constitution by election. If that were even remotely the case we would have no need for a Constitution.

As for Justical review yes I understand the court Gave itself that power 200 years ago, although even then the court was not so arrogant to claim it has the only or even final say on the matter.

As Thomas Jefferson himself recoiled upon that sujestion it is utter madness to give the Federal Employees in black robes the final say on the limits of not only the power of their appointers but themselves is to render them limitless in their power and the Constitution as written, amended, and ratified utterly meaningless.

All spending originates in the House of Representatives. For the first six years of Bush’s term when the Republicans controlled Congress spending averaged about 200 billion per year. For the last two years of Bush’s term the Democrats were in control of both houses of Congress and spending was 1.9 trillion and 2.0 trillion for those two years. The Democrats increased spending 1000% and blamed it on Bush.

More was spent on Obama, Pelosi, and Reid’s so called “stimulus” bill than was spent in eight years of the Iraq war.

Unemployment was 4.7% when the Democrats took over, it has gone downhill from there. Now unemployment is more than twice that and the media keeps calling it a recovery. It is obvious to anyone that can pay attention that the media covers for Democrats and rakes Republicans over the coals. Bush was far from perfect but you seem to have fallen for the Liberal media’s bias and think everything is all Bush’s fault. I bet you think Obamacare is all Bush’s fault to.

The economy was not bad at all until the Democrats took over. The Democrats controlled Congress for the last two years of Bush’s term so Bush didn’t have any real power for those last two years. So how do you blame a man who has had no real power for over four years for what is happening now when things were much better when he did have real power?

Agreed. Also, I don’t think they meant for the judiciary to exercise the power they have. Been down hill since Marbury v Madison.

It’s my understanding that this decision was based on the precedent of the 1942 Wickard v. Filburn case, possibly the worst Supreme Court decision in history.

If that is the case, it may be that the argument must be made through another avenue, another case that detours around Filburn.

It is only as hopeless as your determination to stick to your plan which has been PROVEN again and again to be faulty and unworkable over the last 100+ years.

The Federal Government has already been overthrown and replaced by an imperial goverment of self-defined powers.

If we cannot find a way to overthrow that imperial goverment we will NEVER restore any kind of federal goverment of limited powers.

You ask why I am here, I am here to help figure out how to do that, and get others to move their pieces to the places we need them on the board to accomplish these ends.

I figure we can destroy the imperial goverment if we so weaken the monster as to be indefensible, then attack it from all sides. We can also effect its destruction by approaching the problem form the other end and letting the left crush it with debt and obligation, while we quietly move ourselfs out from under it.

These lower court rulings are troubling to me mainly because of the effect they might have on Kennedy's decision.
