A federal appeals court in Cincinnati on Wednesday upheld the health-care law passed by Congress last year, saying the law's requirement for most Americans to carry insurance or pay a penalty is constitutional.
The vote was 2-1 on the three-judge panel on the key question of whether the insurance requirement exceeded Congress's powers under the Commerce Clause of the U.S. Constitution. The majority concluded that it did not.

Stevens, Breyer, Sotomayor, Ginsburg, Kagan, and Kennedy will vote for the mandate for the reasons given by Sutton in the 6th Circuit opinion today.
Roberts, Alito, and Thomas will dissent, with Thomas writing separately and alone.
Only Thomas will get it right, again, just as in the Raich case.

I’m embarrassed I live in Ohio.
This isn’t the kind of case in which Kennedy would vote with the liberals. It’s usually the social issues like abortion and the death penalty where Kennedy sides with the liberals. There’s been at least two cases where Kennedy voted to strike down federal laws that violated the commerce clause, and if he voted to strike down those laws I don’t see any way that he’ll vote to uphold Obamacare.

You can also bet your bottom dollar that when the SCOTUS finally gets this case (and they will), Elena "The Bulldyke" Kagan won't recuse herself, even though she co-wrote the Obama Communist Health Care Takeover.
We are not a nation ruled by law anymore. In Philadelphia, they are a city within a state that permits the open carry of firearms. The cops and the mayor there simply ignore the law, and harass, intimidate, assault, and then charge law abiding citizens while letting the racist black "flash mobs" go Scott free.
