Rule 89 has to do with compelling a quorum. It does not define the quorum. On page 133 of the book at your link, it says that 3/5ths of the body must be present for bills which pass taxes or appropriations. The business before the Wisc senate does neither.

I'm still confused here. It seems to me that only a majority needs to be present, and the Dems are not needed for a quorum.

Another interesting section is Senate Rule 95. It holds that rules may not be changed without the consent of 2/3 of the members present. It seems to me that the Repubs could have a lot of fun here if they declared a quorum (majority of members, all R) and started making rule changes that would upset the Dems.

OMG....I didn’t realize this is the same place. My sweetie and I stopped there on our way to WI over Labor Day. We were heading to Galena and Taliesin for a visit. LOL We even stopped at the Tilted Kilt on the way back. He liked it the first time (what’s not to like for a guy? lol) and they had excellent food.

Wait until he calls me an I tell him this. He will be howling with laughter.

This is a good question. At first I thought it was because it was 60 percent of the body, but no quorum rule I know of is written like that. So ... Wisconsin Senate Rule 15. http://nxt.legis.wisconsin.gov/nxt/gateway.dll?f=templates&fn=default.htm&d=rules&jd=senate%20rules Senate Rule 15. Roll call, quorum. Before proceeding to business, the roll of the members shall be called, and the names of those present and those absent shall be entered on the journal. A member present during any part of a roll call day shall be included in the official attendance roll call for that day. A majority of the membership presently serving must be present to constitute a quorum for the transaction of business; a smaller number, however, can adjourn and may compel the attendance of absent members. When a roll call discloses the lack of a quorum, further business may not be conducted until a quorum is obtained, but the members present may take measures to procure a quorum or may adjourn.

So, it's not a quorum issue. There are 19 Republicans and 14 Democrats, so unless there are only 16 Republican votes, a quorum exists.

Maybe - just maybe - the dems shot themselves in the groin by leaving today and if they don’t come back tomorrow another session can start with a smaller quorum of 19. Then the pubbies just pass any and everything they want in that session that lasts for as long as they can keep it open...

Wouldn’t that be great?

It’s a smallish chain of restaurants. Good food, eye candy for the bf; nothing more than you can see on TV every night, however. In fact, I have a photo in my camera of him and our server that I need to have developed as a souvenir of our trip.

He’s calling on the air for the Wisconsin State Police to be on the lookout.

YES! I knew Mark would be on this. He is tape-delayed three hours in my area. I'll listen at 9PM. He'll have a good take on the legal ploys the pubbies can use, too, against these traitors.

A quorum is the minimum number of members of a deliberative assembly necessary to conduct the business of that group.

A quorum may be a majority, some number greater than a majority, or some number less than a majority.

The number of members that constitutes a quorum differs depending on the assembly and is usually provided for in that assembly’s governing documents (for example, its constitution, charter, or bylaws). The quorum may also be set by law.

Apparently, in the WI Senate, 20 members are required to have a quorum and not just a majority of 17.

Willful abrogation of duty can be interpreted as a resignation by the executive branch of the government.

If your boss tells you to come into work, and you refuse, its the same thing as saying “I Quit”.

The governor should proceed along those lines.

Although I understand the nature of a quorum I've seen several different threads talking about what Wisconsin's Senate's quorum rules are. I have no doubt I've gotten it wrong, but I'm still trying to search for some understanding of what the pubbies are up against in fighting the dems absentee tactic.

The one thing that is clear is that they can require that they return and they can assess fines. Those fines ought to be steep. They ought to hurt, reflective of how much this stunt has cost the taxpayers, the schools, law enforcement, etc.

The Rule 89 I was looking at deals with the Sergeant At Arms going after absentees who are AWOL. Seems to me that could apply here :)
