A military jury has convicted an Army doctor who disobeyed orders to deploy to Afghanistan because he questions President Obama's eligibility for office.

I don't think so. Appeal is guaranteed depending on the sentence that the court martial imposes. But since Lakin pled guilty to all but one of the charges, the additional punishment incurred from the missing movement conviction may not rise to the level of an automatic appeal.
Wintertime,
Sheesh. You sound like a liberal on this thread. Those Democrats used the same nonsense in 2005 saying that President Bush presided over an illegal war due to wrong intel. We were beating the dems up for that. There were many soldiers who refused to go to war over it and when they went to jail we celebrated.
I know you are not a liberal that is for sure but you just sound like one tonight. Maybe you are tired.
A rock ribbed conservative in the White House would likely pardon Lakin.
This isnt a dig or an attempt to discredit your question or opinion, but I am curious
have you ever been in the military?
You noticed? They are adjustable bed salesmen spouting the party line. "Conservative"? Syndicated "conservative" talk radio died a decade ago. What we hear now are carefully scripted hacks.
If you remember Limbaugh & Liddy from back in the 90s, that was seriously great radio. It's gone.
I doubt it, they are going to get a nice plea agreement for him to go away quietly and possibly keep his retirement or stay out of jail. You don’t sentence a Lt Col with an MD to twenty years, it just doesn’t happen.
Yeah, he's like one of the suckers who listens to one of those goofballs who claims to have discovered a legal loophole that makes it possible to get out of paying taxes.
No. Even if we lived in a fantasy universe where the Birther arguments actually had some merit, the fact is that Lakin’s lawfully appointed superior officers, not Barack Obama personally, gave him the orders he chose to disobey.
No, I am not in the military. I was not born in this country but love it with all my heart. I just don’t know much at all about military justice. I read a lot, but legalese is tough to understand.
"MAJ Dobson, the doctor who had to replace LTC Lakin on short notice, testified next. He recounted how two days after arriving in theatre, the unit suffered a mass-casualty attack, with sixteen wounded. He said that he was not, in his opinion, as well-prepared to deal with the attack as he would have been had he had longer to prepare for operations at the FOB." Link
How many men died so Lakin could have the opportunity to go down in flames?
Not a chance. Nobody, of any political strips, is going to undermine civilian supremacy over the military.
“I don’t think citizenship is a requirement for a stretch at Leavenworth.”
Its Ok for Obama to go there too? Are you sure the Kenyan Government can’t stop us from putting him in there?
“Gee! And to think that all this could have been resolved with a nod of the head from Obama and the release of a few key documents. Obama doesn't release them because he can't.”
Why on God's green earth would he ever want to end a spectacle that serves as such an embarrassment to his oppositions? If anything, his people are probably poking the Birther movement with a stick every time it shows signs of going into hibernation.
“How many men died so Lakin could have the opportunity to go down in flames? “
For a 10 dollar BC. Soebarakah should be ashamed. But I dont know if they have that concept in Kenya.
I believe that the maximum sentence Lakin is on the hook for is three and a half years. That and being cashiered and losing his pension. I don't know how much jail time he'll actually get but I'm sure there will be some. The cashiering and loss of pension is a given.
“A military jury”
Remember the chain of command still works, jury or not. They worry about their performance reports.
No. Even if we lived in a fantasy universe where the Birther arguments actually had some merit, the fact is that Lakins lawfully appointed superior officers, not Barack Obama personally, gave him the orders he chose to disobey
It seems like an unwinnable scenario. He has sacrificed EVERYTHING, for nothing. My heart goes out to him.
What this shows us that no one in power in our military has any cahonies. When you start grinding up good men the end is in sight. Recall that we hanged Germans for obeying illegal commands.
