Sunday
2 p.m.: The House will debate for one hour the rules of debate for the reconciliation bill and the Senate bill.

3 p.m.: The House will vote to end debate and vote on the rules of the debate.

3:15 p.m.: The House will debate the reconciliation package for two hours.

5:15 p.m.: The House will vote on the reconciliation package.

5:30 p.m.: The House will debate for 15 minutes on a Republican substitute and then vote on the substitute.

6 p.m.: The House will vote on the final reconciliation package.

6:15 p.m.: If the reconciliation bill passes, the House will immediately vote on the Senate bill, without debate.

The KEY point from Hensarling is that Peelousy did NOT put the Doc Fix in front of the CBO and promises to bring it back up.

Without the Doc Fix, the HC bill ‘saves’ money, but as soon as the Doc Fix is back then it goes deficit spending...

Barton then asked whether there would be some period of time between House passage of the Senate bill and House passage of the HCR amendments. During that period of time, the president would sign the Senate HCR bill into law. For the House to amend the HCR law, Barton said, it has to be law, which means the president has to have signed it. “If he doesn’t, it ain’t a law,” Barton said.

Democratic Rep. Sander Levin jumped in. “We’re going to be amending the law,” he claimed. Waxman added, “We change current law, and the current law will be the Senate bill once it’s voted on in the House.”

Per Clinton v. City of New York, Justice John Paul Stevens wrote for the majority:

" ... 1) a bill containing its exact text was approved by a majority of the Members of the House of Representatives; (2) the Senate approved precisely the same text; and (3) that text was signed into law by the President. The Constitution explicitly requires that each of those three steps be taken before a bill may “become a law.”

" ... Once a bill becomes law, it can only be repealed or amended through another, independent legislative enactment, which itself must conform with the requirements of Article I."

The relevant text from Article I, Section 7 is as follows:

" ... “Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States; If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered, and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively. If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law.”

If the "Slaughter Rule" is used, the constitutional question would turn on whether the phrase "all such cases" means ONLY bills returned to Congress for possible veto override, or if it means ALL bills.

If it means ALL bills - then "deeming" is unconstitutional, since there will be no recorded votes for it.

Chief Actuary: ‘I regret that my staff and I will not be able to prepare our analysis within this very tight time frame, due to the complexity of the legislation.’

WASHINGTON, DC – The Obama administration’s chief actuary at the Centers for Medicare and Medicaid Services (CMS) notified Republican leaders Saturday that the “very tight time frame” and “complexity” of the Democrats’ health spending bill would prevent them from fully analyzing the costs and efficacy of the bill before the House voted on the legislation. The letter was in response to a request from House and Senate Republicans.

Did I just hear this right? In the House Rules Committee, it was just noted the costs of the extra personnel for the IRS are not accounted for in the bill?!

I thought I heard that too! Are they kidding???

It seems part of the GOP strategy is to ask for an open debate on the floor - like the Dems are going to go for that!

There ya go, regardless of whether or not CBO plays it straight or not (which I honestly don’t know), if you feed garbage into the CBO, you will get garbage out. If any American can’t get a grasp on these type of basic things at this point in time, ...
