11 AM Stupak press conference

12 PM Demonstration at the Capitol

3 PM Obama meets with the Democratic caucus

Sunday
2 p.m.: The House will debate for one hour the rules of debate for the reconciliation bill and the Senate bill.

3 p.m.: The House will vote to end debate and vote on the rules of the debate.

3:15 p.m.: The House will debate the reconciliation package for two hours.

5:15 p.m.: The House will vote on the reconciliation package.

5:30 p.m.: The House will debate for 15 minutes on a Republican substitute and then vote on the substitute.

6 p.m.: The House will vote on the final reconciliation package.

6:15 p.m.: If the reconciliation bill passes, the House will immediately vote on the Senate bill, without debate.

Jeb Hensarling R-TX, is reading from a letter from CBO to him. Regarding the implementation of the Senate Bill + Reconciliation Bill + “Doc Fix” and CBO says that the combination of the three will ADD $400 Billion over ten years...FAILS to reduce Deficit...MUST include the 21% pay fix to Drs!!

I don’t know what your point is to me. I didn’t say it had been addressed by SCOTUS. Neither did Levin.

Many issues are addressed by SCOTUS for the first time after simmering somewhere for years. The old saying, there’s a first time for everything.

I am addressing only one thing. A lady called in to Rush, saying she worked in the Republican Justice Dept. and she believed a provision of the Constitution allowed 20% of House Members to demand and get a recorded vote on a piece of legislation. The problem is, she was saying that this could be used to demand a recorded vote on the Senate bill, which is what the Dems are trying to shield from being voted on, and want to wrap up and cover within a bill of changes to the the Senate bill, in which the vote would not be on the Senate bill itself, which would be written up as having been Deemed and Passed.

Levin called after she was on and said this would not work in the case at hand. He isn’t talking about a prior ruling or a current court case...he’s talking about the situation in the House that the lady thought a Constitional Provision could be used to force a vote. And in this situation, he correctly pointed out that until a bill is brought to the Floor for a vote, you cannot have 20% of members stand and demand a recording of the yeas and neas.

And the Dems are planning NOT to put the Senate bill on the floor for a vote.

David Dayen at the left-wing Firedoglake website has been doing an excellent job of keeping track of the votes on the health care bill. His latest count, as I read him, is 202 committed yes votes, 206 committed no votes, 12 still undecided and 11 “Stupak votes”—Democrats like Bart Stupak (MI 1) who oppose the abortion provisions of the Senate bill. In Dayen’s view, Speaker Nancy Pelosi needs all 12 undecided votes plus 2 Stupak votes. No wonder that she was negotiating as late as this morning with Stupak—and it’s not a good sign for her that the negotiations have apparently broken down.

Here are the members in each of Dayen’s categories.

Undecided and voted no on House bill in November (4): Tanner (TN 8), Matheson (UT 2), Nye (VA 2), Baird (WA 3). Tanner and Baird are not running for reelection. Matheson’s brother was recently nominated for a federal judgeship; he appears to have fine credentials.

Undecided and voted yes on the House bill in November (8): Bean (IL 8), Foster (IL 14), Michaud (ME 2), Pomeroy (ND 1), Space (OH 18), Carney (PA 10), Kanjorski (PA 11), Ortiz (TX 27).

Stupak bloc (11): Berry (AR 1), Bishop (GA 2), Lipinski (IL 3), Costello (IL 12), Donnelly (IN 2), Stupak (MI 1), Driehaus (OH 1), Kaptur (OH 9), Dahlkemper (PA 3), Mollohan (WV 1), Rahall (WV 3).

Is it impossible for the Democratic leadership to get to the 216 yes votes needed for a majority? No. Sometimes a member can be persuaded to vote yes even if he or she has made a public commitment to vote no. Is it difficult for them to get to 216? It sure looks like it.
