..the better question is why isn’t the GOP asking the question?
where the heck is GOP? Vacationing in Hawaii?
Had GOP done this, State Media and dems would be all over this 24/7.
..the better question is why isn’t the GOP asking the question?
Democrats only have to follow rules that the state-run media wants them to follow.
Perhaps the State Pooh-Bah of elections has not yet certified the results.
The issue could be State Govt.
The very question I asked yesterday when I saw them passing stuff with 60/40 vote counts.
Doesn’t McConnell care?
Instead of yucking it up on Leno, Brown should have been demanding that he be seated so that he could 41 this debt limit rise.
I hope this doesn’t indicate the kind of Senator he’s going to be
The GOP is letting this slide because the entrenched Republicans in Congress want each of these things to pass, but don’t want to have to vote for them. So they let Kirk vote and do their dirty work for them.
If you ever needed proof that the Republicans in the Senate are a bunch of manipulative, two-faced cheaters with absolutely no committment to principle, now you have it.
Rule Of Law is for suckers.
Uh, maybe it has to do with Senator Paul Kirk (D-MA) still being Senator from MA until Scott Brown is sworn in as Senator from MA on Feb. 11?
When is the guys term officially over? I don’t think MA has finalized the election results and sent the certification to the Senate. When is that to be done by state law in MA? Anyone know?
Because the spineless GOP is letting it happen.
He is the legally seated Senator until the Election Commission certifies Scott Brown and he is sworn in.
Uh, maybe it has to do with Senator Paul Kirk (D-MA) still being Senator from MA until Scott Brown is sworn in as Senator from MA on Feb. 11?
I recall this question came up before the election, mostly regarding Kirk’s ability to vote on the healthcare bill. Republicans were [apparently] firm at the time that Kirk could NOT vote after the election. Period.

” ... based on Massachusetts law, Senate precedent, and the U.S. Constitution, Republican attorneys said Kirk will no longer be a senator after election day, period. Brown meets the age, citizenship, and residency requirements in the Constitution to qualify for the Senate. Qualification does not require state certification, the lawyers said.
An appointed senators right to vote is not dependent on whether his successor has been certified, the lawyers said.” “ ... The Republican lawyers also said Senate precedent is clear on when a new senators term begins and the term of an appointed senator ends. In a number of cases, the pay of a senator who replaces an appointee was determined to begin on the day after the senators election. “
