Burglar's Loved Ones Want Charges Against Shooter (NE)

An Omaha woman is mourning the death of her boyfriend, a suspected burglar shot and killed by a business owner over the weekend. She believes that business owner should be charged with a crime.

Police say Jesus Franco broke into the business near 24th and I streets around 4:30 a.m. Saturday, struggled with the owner and then ran from the scene after being shot. Police found Franco dead a few blocks away, alone in his car. Click here to find out more!

Lynn Pecha is overcome with grief. Franco's girlfriend does not believe the story. “It's not right, he didn't have no weapons on him, the cops never found weapons and the guy said he had a knife. There was no knife.”

Lynn's mother agrees that charges should be filed against the business owner.

"The scenario was he broke into the business, doesn’t give a person the right to shoot somebody, especially if you don't see a weapon,” said Deana Arellano.

“Then no weapon was found, doesn’t give you the right to shoot somebody. There are laws against that and I think there needs to be a full investigation.”

The cops need to pay a visit to these “loved ones” and beat them within an inch of their lives, THEN arrest them for receiving stolen goods and for being accessories...

so the unarmed who break into businesses and then have co-conspirators HIDE guns are given a free pass?

How do we KNOW he did not have a weapon? The THIEF RAN AWAY after being shot.

Actually, in my book it does. You have no idea what the person coming at you intends to do, nor what he/she is capable of. Why put it to a test of strength and fighting skills? I work out, lift weights, and can hold my own against 90% of the people I see on the street. But one of the things having "some skills" teaches you is that there is always someone stronger/faster/better. A fair fight means a fair chance of losing, with possibly mortal consequences. In this scenario, I'd fight to win, and I would use everything I had, including deadly force.

No criminal charges against the shooter does not preclude civil action in Nebraska. Only a few states have adopted laws absolving persons who use firearms in defense from civil liability. Florida has the flagship law, IIRC.

Reason #1 why I have never been on a jury: when a person decides to commit a crime, that person accepts ALL consequences of their action, up to, and including death....

I had a friend who was home one evening. He heard someone break in and had a baseball bat in his room. He called the cops and waited in his room. When the guy came in, he slammed him and did all sorts of damage. When the cops arrived, they informed him, “You should have thrown him out of the house. Now you’re gonna get sued and spend years in court.”

I think it’s more than usually stupid to use “suspect” in this context. It would be much more accurate to say “Burglary Dead-Guy.”

I think the criminals believe that its open season on businessmen in Oklahoma. If they get shot, they can sue or the police will press charges against the businessman for defending his/her property. The pharmacist that is being prosecuted in Oklahoma is the example that gave the criminals that mentality.
