Jim DeMint to Force a Vote on Constitutionality of the Individual Mandate
RedState ^ | December 22, 2009 | Erick Erickson

Posted on 12/22/2009 11:22:29 AM PST by bobsunshine

..Jim DeMint and John Ensign are going to force a vote on the issue. Democrats will be forced to take a position on whether or not the federal government can force individuals to buy products on pain of criminal penalty.

“I am incredibly concerned that the Democrats’ proposed individual mandate provision takes away too much freedom and choice from Americans across the country,” said Senator Ensign. “As an American, I felt the obligation to stand up for the individual freedom of every citizen to make their own decision on this issue. I don’t believe Congress has the legal authority to force this mandate on its citizens.”

“Forcing every American to purchase a product is absolutely inconsistent with our Constitution and the freedoms our Founding Fathers hoped to protect,” said Senator DeMint. “This is not at all like car insurance, you can choose not to drive but Americans will have no choice whether to buy government-approved insurance. This is nothing more than a bailout and takeover of insurance companies. We’re forcing Americans to buy insurance under penalty of law and then Washington bureaucrats will then dictate what these companies can sell to Americans. This is not liberty, it is tyranny of good intentions by elites in Washington who think they can plan our lives better than we can.”

Actually, I’m all for a real civil war. I want my country back.

Yes, we need our country back, but it will take a gargantuan effort to "reset" this country, and a civil war may be the only mechanism to effect this. Half measures will not do.

The leftist haters of America must go. And they will have to be made to go by force.

>Get the popcorn.

No, not popcorn. Get your gun, ammunition, food, fuel for your vehicles... start planning and preparing as if for an extended military campaign.

Get your militia together and drill... remember, that’s what Lexington was [partially] about. (It was also partially about the British wanting to ‘inspect’ the stockpiled arms.)

Thank you, thank you, thank you. Someone gets it.

I agree completely. As much as I do not want a war in this country, I'm afraid there is no other way to perform a hard reset of the bureaucratic machine that has become entrenched in DC.

I just don't see any way to vote our way out of this, even if it IS what a majority of the population wants. As we are seeing now, the ruling plutocracy has no compunction about shredding the Constitution in broad daylight, and they simply will NOT give up power peacefully.

Understood,(both parties are guilty) but it has reached a whole new level. It’s as if the Constitution doesn’t even exist.

next time we need to add a provision stating that ANYONE who ignores the constitution will be shot. Maybe then they honor their promise to uphold it.

Yes, a Civil War in the courts....

Does anyone on FR honestly believe that SCOTUS is going to knock down the man-child messiah's signature legislation piece? Come on people, they would not even address his right to run for President, they sure as he$$ are not going to look into this. Man-child is depending on this signature piece for all the follow-on legislation that he will jam down our throats. He must have this in place by Jan 20 so he can have bragging rights for destroying the country. There is no urgency since 90%+ of the benefits do not kick in for 4 years - Harry Reid just told us that thousands are dying every week because they lack health insurance, but yet he jams through a bill that continues to kill thousands of Americans while they wait for 1-1-2014 to kick in.

CIVIL DISOBEDIENCE IS THE ONLY ANSWER TO THIS TYRANNY.

Can’t he make them get 60 votes to stop discussing whether it is constitutional?

There is a reason that Jefferson and other founders referred to the right of the people to revolt and replace a tyrannical government, even though they had already created the best political system the world has ever seen. They knew that while every effort should be made to correct government abuses through the system, eventually even the best system succumbs to the worst aspects of human nature writ large via the absolute power of government.

This generally occurs once enough of the people have become so degenerate and self-centered that they elect corrupt politicians who tell them what they want to hear, rather than standing for what is right. In this regard, our enemies are not only the corrupt politicians BUT ALSO THE VACUOUS, SELF-ABSORBED MASSES WHO PUT THEM IN POWER. The Founders expressed a number of times the fact that with the wrong type of people (self-absorbed, irreligious, immoral), this country could not function as designed.

So, while the Founders clearly intended that the Second Amendment be put to its designated use in the event that a government became contemptuous of the will of the people, and while we are clearly approaching that point, winning a real war would accomplish only temporary relief unless we also win the CULTURE WAR. We must somehow find a way to begin to reverse the cultural corrosion that has brought us to this point. I think we begin by absolutely refusing to bow to any more politically-correct dictates from the left. Whether at work, in school, or in our personal lives we must stand up to the PC goons.

You're required to attend a diversity class? Go, and challenge every ridiculous assumption that they make. You're called a racist? Tell them to grow up, take responsibility for themselves, and stop calling people childish names. Your office requires you to recycle? Tell them that trees are a crop, and that recycling paper makes as much sense as recycling corn - then ceremoniously throw the paper in the TRASH. For every one person who publicly stands up in this way, I guarantee there are 100 others who sympathize but are being intimidated into silence. IF WE CAN JUST GET THE "SILENT SYMPATHIZERS" TO STAND UP, WE CAN MARGINALIZE THE IDIOTIC LEFT AND THEIR BIZARRE IDEAS AND BEGIN TO WIN THE CULTURE WAR.

I have seen this approach in action at my workplace. I have challenged PC orthodoxy in meetings only to see the entire room erupt in cheers. They were even chanting my name once when I confronted our Mayor during a public meeting. It got so raucous that the Mayor had to stop speaking until the uproar died down. Yet seconds before I spoke out, the room was so quiet that you would naturally assume that everyone agreed with the nonsense being disseminated. There are a LOT of people out there who agree with us, they just have to be shown that it's safe to jump in the water and take on the PC leftists.

I contacted Sen De Mint. We have little hope elsewhere. Certainly my CA Senators care little for freedom, the American people, or the Constitution they swore to uphold. I thanked him for his fight and urged him not to give up.

I’ve always like DeMint. He is a real Conservative who has fought tirelessly for America. He and his staff understand that they work for the American people, not just those from his staff, unlike most of the Democrats. His staff never asks where you are from. If DeMint ran for President, I’d probably back him.

Nice thought. I like Sarah, but I don’t think this would be the ticket.

Merry Christmas!
