The Posse Comitatus Act is a United States federal law (18 U.S.C. § 1385) passed on June 18, 1878, after the end of Reconstruction, with the intention (in concert with the Insurrection Act of 1807) of substantially limiting the powers of the federal government to use the military for law enforcement. The Act prohibits most members of the federal uniformed services (today the Army, Air Force, and State National Guard forces when such are called into federal service) from exercising nominally state law enforcement, police, or peace officer powers that maintain “law and order” on non-federal property (states and their counties and municipal divisions) within the United States.

The statute generally prohibits federal military personnel and units of the National Guard under federal authority from acting in a law enforcement capacity within the United States, except where expressly authorized by the Constitution or Congress. The Coast Guard is exempt from the Act during peacetime.

In light of this decision coming down 5 to 6 months ago, how does this play with Mr. Holder’s horrendous decision to make the trials of KSM and the other 9.11 conspirators a federal civilian case and not a military case?

This seems to set the table for a mistrial or outright dismissal, based on the fact that none of these animals was mirandized. If they were, please correct me, but I have read nothing about it.

I sure wish someone would connect those dots; that could be extremely uncomfortable for Zero.

Miranda rights are supposedly established under the Constitution. Is Obama claiming the authority of the US Constitution extends to foreign countries? If not, under what authority does he submit they have those rights?

The practice has not been instituted at detention facilities in Iraq or at Guantanamo Bay, according to U.S. senior military officials. Asked if the Obama administration had ordered that Miranda rights be read to certain detainees, White House spokesman Robert Gibbs said, "I have no reason to disbelieve a member of Congress. But I don't know any of the circumstances that are involved around it." But Gibbs acknowledged that it wouldn't be a surprise to find out that it was happening. Justice Department spokesman Dean Boyd denied there has been a policy change covering detainees. "There has been no policy change nor blanket instruction for FBI agents to Mirandize detainees overseas," he said in a statement, adding, "While there have been specific cases in which FBI agents have Mirandized suspects overseas, at both Bagram and in other situations, in order to preserve the quality of evidence obtained, there has been no overall policy change with respect to detainees." Some senators wonder what would have happened if Khaled Sheikh Mohammad, a self-confessed architect of the Sept. 11 terrorist attacks, had been read his Miranda rights. "I'd be very concerned if we're sending FBI agents over to Bagram Air Base in the middle of a military operation to start reading Miranda rights to detainees caught on the battlefield," Sen. Lindsey Graham, R-S.C., said.

More than 60% of the Afghan population is illiterate.

According to British military charged with training Afghani police, more than 90% of the police are illiterate, and when told they would be taught how to fill out police reports during schooling, the Afghani police didn’t understand the concept of a classroom.

Over 10% of Afghani suffer from some form of TB.

Over 78% of the population do not have improved drinking water.

Over 70% of the population do not have santitation.

Mirandi Rights are the luxurious human rights afforded advanced societies once the vast majority of stakeholders have reached basic human rights and can afford through production surpluses to spend collectively some of the surplus to expand the civil rights of the upper classes.

There is a reason the Magna Carta was produced in England and not in central Poland.

The irrational chain of arguments concocted to justify and implement Miranda Rights in a 3rd world, substinence economy war zone displays a total lack of education, understanding and insight on the very foundations of Western concepts of human rights.

It further shows a complete lack of understanding of the basic underpinnings of economies, be it totalitarian OR laissez faire, the person who implemented this plan doesn’t understand the basic concept of the value of physical labor in society, and doesn’t understand the concept of value and wealth. Nor can they differentiate between the concepts of value and wealth. The persons responsible for this are not schooled in von Mises or Marx nor anywhere in the spectrum, they are unschooled and incoherent.

This also explains why Obama caved in to the Wall St crowd, he and his legalistic advisors are completely void of basic knowledge of economies, human rights, and the concepts of fair value of labor and the expenditure of wealth to protect the rights of the populace as a whole.

Krugman, Volcker and Goolsbee know better, I dare say they had no input on this policy decision.
