Well, now we know why Obama doesn't use the term "war on terror" anymore - he doesn't consider terrorism an act of war. Instead, he has taken us back to the days of Bill Clinton, when terrorist acts were treated like a "crime."
In a story reported in The Weekly Standard , Representative Mike Rogers (R-Mich) is accusing the Obama administration of ordering the F.B.I. to read Miranda rights to detainees being held at U.S. military facilities in Afghanistan.
This is creating a great deal of damage on the battlefield, not to mention how it is affecting the security of our military men and women overseas. Said Rogers:
I witnessed it myself, talked to the people on the ground. What you have is two very separate missions colliding in the field in a combat zone. Again, anytime that you offer confusion in that environment that's already chaotic and confusing enough, you jeopardize a soldier's life.
Why would Obama issue such an order? It's all a part of a policy shift referred to as the new "global justice initiative," which was described in a May 28th Los Angeles Times article:

Miranda rights are supposedly established under the Constitution. Is Obama claiming the authority of the US Constitution extends to foreign countries? If not, under what authority does he submit they have those rights?

"There has been no policy change nor blanket instruction for FBI agents to Mirandize detainees overseas," he said in a statement, adding, "While there have been specific cases in which FBI agents have Mirandized suspects overseas, at both Bagram and in other situations, in order to preserve the quality of evidence obtained, there has been no overall policy change with respect to detainees." Some senators wonder what would have happened if Khaled Sheikh Mohammad, a self-confessed architect of the Sept. 11 terrorist attacks, had been read his Miranda rights. "I'd be very concerned if we're sending FBI agents over to Bagram Air Base in the middle of a military operation to start reading Miranda rights to detainees caught on the battlefield," Sen. Lindsey Graham, R-S.C., said.

Then he gets all the respect and consideration the Constitution demands for someone with such a claim of authority.
But don't you think that since Obama and Holder are giving 9/11 terrorists a fair trial with mom and apple pie in NY that the very reasoning of the GLOBAL PEACE INITIATIVE and Obama's orders/ROE killing our soldiers are relevant FACTS they should atleast by now be reporting?

A report on a radio show mentioned that in the case of KSM at least, a “clean” FBI team without access to intel info but armed with US Court level evidence, restarted the questioning process and that this info, not the classified stuff, will be the basis of the trial.
This confirms your post, despite the official denials, that there are teams of FBI gathering evidence etc, for some HVT’s in Afghanistan.

Exactly...we’re operating in a foreign country. How do our laws apply? LOL, I think we should turn all our prisoners over to the afgans/paks. If its anything like IRQ the police will give them a good beat down and then send them off to jail (which is almost a death sentence).
