Doug Hoffmann in NY 23 says he is within 2000 votes! Count should be done by Thursday!

Doug Hoffman just told Glenn Beck they are 2000 votes behind in NY 23with 10,000 absentee votes left to count.

This is NOT over.

Agreed. I consider Thune’s loss to Johnson the setup for a greater and better cause.

Oh my it is getting closer and closer. I want to see SanFranNan’s face if she has to unswear him in! Will make it much harder for them to ram healthcare and all of the other Obama follies through.

"Just because they marked Hoffman doesn't mean their INTENTION was to vote for him, we have to call that for Owens."

MNJohnnie, didn’t the person he ran against vote recently for the Health Care bill? I thought I had heard that he raced to the capital to participate in that vote.

If Hoffman is declared the winner, that vote would have to be withdrawn.

Especially military validity, as they did in Florida.

No the vote stands. There is a legal principal involved. Heard a Conservative lawyer explaining it. It seems under the law there is something like “Defacto authority” that based on the facts at the time he was defacto in office anything he does until the facts change are legally binding

Can someone with some expertise on constitutional law post a brief explanation on how a congressional candidate that has not been certified as the election winner can be sworn in and vote?

No expertise, per se, but all you need to do is read the Constitution, Article I, Section 5 - Membership, Rules, Journals, Adjournment:

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members ...

Regardless how people think concession *doesn't count*, the House seated the projected winner of the race, if it becomes contested, the House will do a re-count. Sam Gjedenson won re-election up in Connecticut by TWO VOTES some years ago, there is also precedent of the Democrats cheating, leaving votes in the box and seating their candidate over the obvious GOP winner, see Panetta, Gingrich, and what Michel did to anger his conference to allow Gingrich to move from back-bencher to Minority Whip.
