9/11 Mastermind Khalid Sheikh Mohammed to Be Tried in the City He Attacked, NYC

It could jeopardize counterterror programs and thereby endanger Americans, but who cares? "9/11 mastermind Khalid Sheikh Mohammed to go on trial in New York," from the Telegraph, November 13 (thanks to Anne Crockett):

President Barack Obama said the September 11 mastermind Khalid Sheikh Mohammed and four other Guantanamo Bay detainees will be put on trial in New York City. Speaking in Tokyo, Mr Obama said Mohammed, the self-proclaimed organiser of the al-Qaeda terrorist plot that killed almost 3,000 people in 2001, would face "exacting" US justice.

Bringing such notorious suspects to US soil to face trial would be a key step in Mr Obama's plan to close the US detention centre at Guantanamo Bay.

Mr Obama initially planned to close the centre at the US naval base on Cuba by Jan 22 next year, but his administration is no longer expected to meet that deadline.

It is also a major legal and political test of Mr Obama's overall approach to terrorism. If the case suffers legal setbacks, the administration will face second-guessing from those who never wanted it in a civilian courtroom.

Indeed.

The New York case may force the court system to confront a host of difficult legal issues surrounding counter-terrorism programmes begun after the 2001 attacks, including the harsh interrogation techniques once used on some of the suspects while in CIA custody. The most severe method - waterboarding, or simulated drowning - was used on Mohammed 183 times in 2003, before the practice was banned.... It's up to you, New York, New York!

By granting him constitutional rights a plethora of legal issues pop up.

Miranda.
Right to a speedy trial
Chain of evidence.
Right to an attorney during questioning

And these are just off the top of my head.

yep...which means this POS will “walk” if tried in NYC...

the Ft. Hood Shooter’s attorney has already complained that he, the attorney, was not present when the shooter was formally charged.

surely not even those on the radical loony left like move on or KOS can defend this.

What message is this to terrorists now/

no problem , kill thousands and you can have a lawyer, go to court and waste millions of dollars of tax payers money and then if you do get find guilty you will go to jail where you can spread the word of Islam .
Then maybe some time in the future you might get out with a prisoner exchange.

This is disgusting and I notice how bozo is out of the country when this gets put out.

You left out the right to question his accusers. The whole network of informants is going to be brought to light and these people are going to be killed by Al Queda the moment their identities are known.

Witnesses will undoubtedly be killed long before the time when the prosecution will be able to bring these assholes to trial.

Does anyone think that Al Queda has more moral convictions than the Mafia?

Does anyone remember how for 40 years in New York City you couldn't convict a Mafia kingpin of jaywalking, much less murder? How many potential witnesses disappeared before they were able to be called to the stand? Does anyone think that won't happen here with these terrorists?

According to Muslims, there were over half a million in 1999. In 2008, estimates ranged from 600,000 to 850,000. Consider the source, of course.

I didn't leave it out, I just put down what immediately came to mind.

You are right, of course.

Other thoughts are the venue of the trial
Interrogation methodology
Revealing government intelligence gathering techniques.

I'm sure an attorney could come up with a few dozen.

Now that BHO has changed the status of KSM from Terrorist
to a "common criminal" who has been severely tortured,
(by moving him form Cuba to the United States)
the ACLU will be free to plead his case
and I believe find some technicality to free
KSM and pay him millions of dollars as the victim of
Bush-Chaney era torture.

BHO will publicly apologize to the sheik for the Bush-Cheney torture.
