A U.S. District Court hearing to determine if a Army captain fighting deployment to Afghanistan because of the challenged the legitimacy of Barack Obama’s presidency was rescheduled for Monday.
Capt. Connie Rhodes filed the complaint last week and Judge Clay Land granted an emergency hearing Friday afternoon in the Columbus federal courthouse.
Rhodes, a medical doctor who was with her unit in Fort Riley, Kan., did not attend the hearing. That prompted Land to reschedule it for noon Monday.
Rhodes is scheduled to arrive at Fort Benning Saturday and deploy within seven days.
Rhodes’ attorney Orly Taitz — a national figure in the “birther” movement — was in Land’s court. Rhodes was ordered by her commanding officers not to leave Kansas, Taitz told the court.
“That is not the information I have from Fort Riley,” said Maj. Rebecca Ausprung, with the Department of the Army, Litigation Division in Washington. Rhodes had not informed her supervisor, Ausprung told the court.
Land made it clear he wanted to hear from Rhodes.
“I am going to require her to appear, so I can ask questions of her,” Land said.
Ausprung said the Army would make Rhodes available.

She took an oath to defend the Constitution against enemies both foreign and domestic. Just because those above her in her chain of command don't take their oath seriously apparently didn't affect her convictions to it. We need more like her.

It would appear Captain Rhodes already had the lesson on the chain of command...
She is required only to obey legal orders coming from legal authority...
At this rate she would not even be given an Article 15...
That would read “for disobeying an order when it was your duty to obey” etc...or words to that effect..
The oath she tool to protect and defend the Constitution of the United States would be meaningless if she had no right to ask for verification when she saw a possible breach in the integrity of her chain of command...
The constitution does not read “the guy is president because he was elected by the people and elected by the Electoral College and sworn in twice by Chief Justice Roberts”..
The constitution is very clear on what is required to make a president of the United States and Captain Rhodes wants verification that the president acting as Commander-in-Chief is duly entitled under the constitution to stand in that office..
Yes, Captain Rhodes is acting like a conscientious, law abiding officer of the United States military who is concerned for not only herself but the junior officers and enlisted personal who will rely on her to make life or death decisions based on the orders coming down the chain of command from the person in the White House who has authority over them all as Commander-in-Chief..
It is odd that people do not seem to understand just how this nation and the laws of this nation and the US miltary work...

No wonder Capt. Rhodes didn't show up to court this morning. She probably had a moment of clarity, looked herself in the mirror and said, "WTF am I doing with these losers! They're going to ruin me!"

If he indeed would (and aren’t you assuming a lot to KNOW what someone else would do??) he would never have became a colonel; you actually have to understand command structure and respect valid inquiries by subordinates even if such inquiries annoy him to some small degree. If he indeed did what you assume he would do he would be guilty of murder..

You must have never served in the armed-forces.
There is a chain-of-command, at the head of which is the President of the United States in his role as “Commander-in-Chief” as per the Constitution. EVERY officer in the Army gets their “legitimacy of command” from the one assigning them (this is the root principal of the “I was following orders” defense of Nurmburg); it can now be seen that if the President is not eligible as per the Constitution then he is not eligible to be commander-in-chief, which makes his authority invalid, just like dressing up as a Col. would not give you valid authority.
This can be seen in the oath of enlistment as well as the officer’s oath, wherein they bind themselves to obey lawful orders issued under the authority of their commander. It should also be noted that the oath is, first and foremost, to the Constitution; against all enemies foreign and domestic.
So then, if the Constitution is being violated by an illegitimate “President” how can the armed-forces be held, by oath to that very Constitution, to obey him?

If you sit back and just follow the proceedings you will get your wish. What’s really got you hacked off ... NOBODY has confirmed that Obama is eligible to be Commander in Chief and he has locked up all documents that can answer the question..
BTW the Hawaiian official said only that a long form exists ,, they made no comment on what it contained .. and yes there are MANY ways it can exist and Obama can still be ineligible.
