A U.S. District Court hearing to determine if a Army captain fighting deployment to Afghanistan because of the challenged the legitimacy of Barack Obama’s presidency was rescheduled for Monday.
Capt. Connie Rhodes filed the complaint last week and Judge Clay Land granted an emergency hearing Friday afternoon in the Columbus federal courthouse.
Rhodes, a medical doctor who was with her unit in Fort Riley, Kan., did not attend the hearing. That prompted Land to reschedule it for noon Monday.
Rhodes is scheduled to arrive at Fort Benning Saturday and deploy within seven days.
Rhodes’ attorney Orly Taitz — a national figure in the “birther” movement — was in Land’s court. Rhodes was ordered by her commanding officers not to leave Kansas, Taitz told the court.
“That is not the information I have from Fort Riley,” said Maj. Rebecca Ausprung, with the Department of the Army, Litigation Division in Washington. Rhodes had not informed her supervisor, Ausprung told the court.
Land made it clear he wanted to hear from Rhodes.
“I am going to require her to appear, so I can ask questions of her,” Land said.
Ausprung said the Army would make Rhodes available.

My son ( father of six) is in the process of applying to the Navy as a naval officer. As a mother, I would like to know that the president is legitimate, not a usurper, and not giving out information or orders that will aid the enemy and kill or wound or soldiers and sailors.
The birth certificate. Which the State of Hawaii says is valid. That’s going to be pretty tough to overcome.

What? One of the craziest statements I’ve seen - perhaps ever. Of course the the Chiefs are in the chain of command - in their respective branches of service. In fact, they are at the TOP of the uniformed chain of command of their respective branch of service.

What do you mean, don't order troops? If the 7th Fleet moves ANYWHERE those orders come from Chief of Naval Operations (CNO), who gets them from the Secretary of the Navy who probably got them from the President himself. The Chief of Naval Operations is the HIGHEST RANKING UNIFORMED MEMBER of the US Navy, period. He is the TOP of the uniformed chain of command, in addition to serving in the capacity of Presidential advisor as a member of the Joint Chiefs.

After the 1986 reorganization of the military undertaken by the Goldwater-Nichols Act, the Joint Chiefs of Staff does not have operational command of U.S. military forces. Responsibility for conducting military operations goes from the President to the Secretary of Defense directly to the commanders of the Unified Combatant Commands and thus bypasses the Joint Chiefs of Staff completely.

I wouldn’t have posted it initially if I wasn’t sure of the info.
I’m certainly not defending him. But when did being honest and straightforward become a legal requirement to hold public office. If you want to talk merely about the legality of him being president, then the only question is, was his origin of birth in the U.S. The state of Hawaii has declared it was. But like I said, I wish you luck in your endeavor. I’m sure the proof is just around the next corner.
An honest, upright, and straightforward man would be **HONORED** to promptly prove his is natural born citizen, and qualified to be president. He would **immediate** release all documentation that was in any way related to his citizenship and natural born status.
So?...What does that say about those defending him?
In theory EVERY order a soldier is given, including ones to clean the latrine originates with the POTUS as C-in-C. I served in the Army for 4 years, the National Guard for 18 years and EVERY chain of command chart that I ever saw revealed an unbroken line from the president right down to my immediate superior. Your division commander doesn’t give you direct orders to clean the latrine, but he is in your chain of command. This is especially true with overseas orders.
That's right, combatant command which deals specifically with combat. But, like many commands in the uniformed services, the chain of command is dotted. If the CNO decides that the uniform of the day is dress blues, guess what. The uniform of the day is dress blues for every swinging (you know what) in the Navy. No one says "Hey CNO - stuff it, because you're not in my chain of command." Ridiculous.
Just like the Commandant of the Marine Corps, who's also on the Joint Chiefs, he's the highest ranking marine in the corps. While Marines are serving in Afghanistan might report to a general who reports to Central Command Commander - who very well may be an Army 4-star, that general still has the Commandant of the Marine Corps in his COC.
I am a Vietnam combat vet and a member on the National Guard for 16 years. I think that she is performing the career equivalent of throwing herself on a hand grenade for her country and the constitution.
Since her orders to deploy are lawful on their face, it is certain that in a properly functioning chain of command, the next step should be a direct order for her to deploy, and a subsequent court martial were she to refuse.

According to Barry’s new ROEs-Sparing the locals and their homes from bombing and shelling is paramount.
Even if they support and resupply the Taliban and sell out the US military.

The locals could shelter Osama bin Laden and Barry’s ROEs disctate that the US military must retreat and allow the bad guys to go in peace.
According to Barry- the lives of the pro Taliban locals will always trump the lives of US soldiers and Marines.
In the flap that ensued after the Germans called in an American airstike in Afghanistan, the AMERICAN liason said the pilot should have refused the order because civilians were present. Excuse me, but how did he KNOW civilians were present?
And had he disobeyed a direct order, what then?

They called in artillery support or air support and got none because someone thought they were too close to civvies. ROE played the MAJOR part that led to their deaths, not some little role.
