This may be a misunderstanding of what Judge Carter ordered. I checked the court docket and here is the entry for the only order issued Sept. 10, 2009:

“MINUTES OF IN CHAMBERS ORDER Referring Motion to Magistrate Judge held before Judge David O. Carter. Court orders First Amended Motion for Issuance of Letters Rogatory and Initiation of Discovery,filed by plaintiffs on August 20, 2009 referred to assigned Magistrate Judge Arthur Nakazato. Accordingly, the noticed hearing date of September 14, 2009 at 8:30 a.m. before this Court is vacated(db) (Entered: 09/10/2009)”

It seems to me that all Judge Carter did was to refer the discovery motion to the Magistrate Judge who is handling the discovery aspects of this case and who Dr Taitz tried unsuccessfully to get removed. Am I missing something?

The thing that worries me the most about this, is that Orly has had great trouble filing in a way that the court can accept. Judge Carter must have the patience of a saint. Isn’t there anybody else who can take over this kind of task? We can’t afford to have Orly loose-cannon herself out of court almost immediately after getting in.

If someone already made this point, please forgive me:

Assuming that Obama has real eligibility problems, Obama’s team MUST take every action they possibly can to avoid making this a test of whether he can prove eligibility based on natural born citizen status. In practical terms, they need to avoid discovery which compels them to produce his birth records or other proofs of his natural born status. Likewise, they need to do everything possible to block Taitz’s ability to obtain any documentation that proves the contrary.

This may sound like an oversimplification, but it is useful for trying to anticipate Obama’s strategy. They must try to block discovery any way they can. First, they must attempt to have the motion to dismiss heard before any discovery takes place. If the motion is denied, they will move for reconsideration, and/or seek to take an appeal to the Federal Circuit Court and from there, to the Supreme Court. All the while, they will be fighting for a stay of discovery to block it while the questions of standing, jurisdiction, justiciability and so on are being adjudicated.

A second line of attack is to seek to obstruct any discovery that is allowed. For example, they will file motions for protective orders barring whatever discovery they can. Typically, the court is supposed to give broad latitude for discovery of any information that is likely to be relevant or to lead to relevant evidence regarding the issues in the case. For those of us who remember the Clinton litigations, they can still use this kind of motion practice to obstruct and delay the issue for months and years, including attempts to appeal every ruling along the way.

I’m not saying this to be discouraging. To the contrary, I’m trying to provide an outline of what to expect as these people are fighting a political life and death struggle for 0. The stakes are the highest imaginable, except possibly treason. Anticipating what they will do will enable us to know how patient and determined we have to be and how Ms. Taitz will possibly need support over the long haul.

One positive note shines through from Judge Carter’s comments: he seems inclined to have the issue determined as soon as possible because the unresolved question is disrupting confidence in the President’s legitimacy at many levels, most crucially the military. If Carter is true to his Marine background (and I have to assume so, even if there are also Murtha’s out there), he may insist that any motions are disposed of quickly and a trial held as soon as possible. He must be strong, because Obama’s got the biggest law firm in the world on his side.

I’d love to hear some feedback on this, especially from FReeper members of the bar.

If this is true, What is the date for discovery?

Barry O. tried to pass of something that was inconsistent with what the rest of have and know to be a “Birth Certificate”.

The so called COLB has many flaws with it:

• His father’s race could never have been listed as “African”.  That was not the nomenclature at all, in the 1960’s.  So that begins the suspicion of a fraudulent document.
•  The COLB is also cropped in many of the pictures, online,  that claim it is a scan.  If it is a scan, why not leave the document and size intact?  It is a computer generated "picture, jpg, gif, whatever" not a scan.
• The COLB, online,  also has no artifacts such as paper folds.  A scan does not make those disappear and in fact will highlight them.
• The COLB that is scanned mysteriously does not show the Seal of Hawaii.  Why?  Because it was computer generated and not scanned.  Guess they forgot to add that back in.
• More over, many of us are concerned and want to know why he wasted time producing a document that is inconsistent with what we know a Birth Certificate looks like.

 The best part and even more confusing is why he didn't release any of the three Birth Certificates we know already existed before 2007.

• His kindergarten records and the BC, that should be there, have mysteriously disappeared.
• The BC he used to get into college, apply for loans and most definitely used to obtain his first passport. That wasn't available?  Where is it and why not use that one?
• Why couldn't he just present the one he found among his mother's belongings upon her death.   He waxed on and wondered about it and his father in one of his books.  Why not post that one?

No mention is made of my mother or me, and I’m left to wonder whether the omission was intentional on my father’s part, in anticipation of his long departure. He seemed to have some emotional attachment to the Birth Certificate found among his mother’s belongings.  Why wouldn’t he just slap that one up, for all the world to see?

So we know he most certainly had and had acces three BC’s and not a COLB(Hawaii didn't start issuing them until 2001). There is no reason to create confusion but, for the fact he is hiding something. That something will be discovered, though.

Hope no one brings up some house fire that vaporized his BC.  That was in 1972 and none of the documents listed here would have been affected by that “fishy” event.

So with all these Birth Certificates lying around, why did he feel it necessary to produce a "Certification of Live Birth" that is inconsistent with a Birth Certificate and wholly lacking all of the information you would find, in you know, a Birth Certificate?

 It seemed important that he found a document that is called a “Birth Certificate” and it is highly unlikely he would not know what one looks like.

Apropos of nothing, my wife and I have taken up family geneology as a hobby. I am 99.5 percent certain that my grandfather was lying about his age his entire life. There is no birth certificate. But when his father died, my grandfather needed to work. He had to be 16 to work in the steel mills. So, my great-grandmother - who did some time in Italy for attempted murder - got a doctor to sign a “Witness of Birth” form, “proving” my grandfather was 16.

In retrospect, it’s a shame that my grandfather did not run for President against Kennedy because Joe Kennedy would have almost certainly have become the original birther.

Judge postpones ‘birther’ hearing until Monday

A U.S. District Court hearing to determine if a Army captain fighting deployment to Afghanistan because of the challenged the legitimacy of Barack Obama’s presidency was rescheduled for Monday.

Capt. Connie Rhodes filed the complaint last week and Judge Clay Land granted an emergency hearing Friday afternoon in the Columbus federal courthouse.

Rhodes, a medical doctor who was with her unit in Fort Riley, Kan., did not attend the hearing. That prompted Land to reschedule it for noon Monday.

Rhodes is scheduled to arrive at Fort Benning Saturday and deploy within seven days.

Rhodes’ attorney Orly Taitz — a national figure in the “birther” movement — was in Land’s court. Rhodes was ordered by her commanding officers not to leave Kansas, Taitz told the court.

“That is not the information I have from Fort Riley,” said Maj. Rebecca Ausprung, with the Department of the Army, Litigation Division in Washington. Rhodes had not informed her supervisor, Ausprung told the court.

Land made it clear he wanted to hear from Rhodes.
