Judge Carter is Granting us Expedited Discovery Immediately

I just talked to Orly:

She has 2 good news items that she is very busy with right now:

1. Judge Carter is ‘giving her expedited discovery - immediately’.

2. Judge Land will allow her to present before the court in GA. She is leaving now to fly to GA to appear before Judge Land at the Federal Building in Columbus, GA at 2:00 pm tomorrow (Friday, 9/11/09).

She would like as many military supporters to be there as possible. I called Carl Swensson (RiseUpForAmerica.com), and he will see what he can do. If you have any contacts there, please advise them.

I was alive in 1961 and quite aware of the elite’s racial terminology at the time. Negro was the way the racially classified Black people in official records.

None did. The moment would seem to be passed for me.

Okay, so the moment has passed for them and you. Shoulda coulda, woulda,....yadda, yadda, yadda.

Now it is time to seek redress of this grievance from the courts.

Just because no one else has taken up this issue, would you pry it from them, forcing their misfeasance as well?

A State official fills out the COLB

Actually it's filled out by a clerk at the hospital, but based on inputs, either verbal or written from a parent, usually but not always, the mother. After it was typed up by the clerk, it would be taken to the mother (or father) to sign, then to the doctor,to the hospital registrar for the final signature. Then, and only then, would it be sent to the state to be filed.

Yes, but they have to get some written information from the parents. The exact name of the child for instance. So there has to be a form that the parents fill out. We don't know exactly what was on that form in 1961 Hawaii.

They have racial terms to be used from the day to select from.

Perhaps. But we don't know exactly what was the list of racial terms in 1961 Hawaii. No doubt it was different from other states since Native Hawaiian was probably one of the major categories. Also we don't know if in certain special cases it was allowed to fill in a race that wasn't covered by the usual selections. Also we don't know if the parents were allowed to specify a race on the form they filled out, or whether the state official would ever use this specification. But we do know that if they were allowed to specify the father's race, that Obama Sr. would quite likely have written "African", because that fits in with the whole atmosphere he was coming from.

Also we do not know if the people filling out the COLB would have said: "Hey this guy is from Africa. He does not fit into the normal categories of white and black Americans. Maybe we should put him down as "African" rather than just "Negro" to make it clear that this is a special case. Of course the person filling out the COLB may or may not have seen Obama Sr. in person.

I doubt that in the 60’s “African” was considered a “race.”

I have already posted some links that show that it was considered a race by some people in the 1960s and earlier.

Politically and socially, the term “negro” as a racial classification was on the outs in the 60’s. Blacks called themselves Blacks during MLK days and that was a challenge to the racial classification term used officially - negros.

Negro was the official racial classification for Black people in the 60’s and an official filled out the COLB and it does not matter what the parents said about the race of the child they would classify the race as it was officially termed in those days.

I wouldn't call a clerk an "official". But a clerk would go by the rules, which existed even in '61.

The clerk only fills out the form, the BC isn't actually "Issued", but the closest that comes to happening would be when the local (hospital) registrar signs it or perhaps when the state registrar accepts/files it, and that block is stamped with the date.

Both the clerk and the local registrar would use standard terms.
