A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.
But the judge did not immediately rule on Taitz' motion to be granted discovery that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

Only because you remember Bill Clinton reigned in by Newt Gingrich and a Republican majority in the House, and a much smaller Dem majority in the Senate. Make no mistake, Clinton was just as leftist as Obama, but he had boundaries set for him on the legislative side. Right now, Obama has none.
I will say this however, Clinton may have been smart enough to see the forces mounting on Big Horn River, I'm not sure Obama is.

It looks like the roulette wheel of the court system where Obama has a high house edge has gone against him. He's going to have to argue this on it's merits.

I don’t agree. Bill Clinton was/is a political animal, a moderate by necessity to write his legacy. Think of how sad he was that 911 happened on Bush’s watch instead of his watch. Think of how he sent cruise missiles up camel butts to make a show of opposing the Al Qaeda terrorists. sinkEmperor was a pragmatic bastard, but he loved this nation in his twisted way. Barry Soetoro, aka Barry Obama, aka Barak Hussein Obama doesn’t care a damn about this nation except as the measn to destroy a nation and rebuild it in a marxist balck power image. And his associations and legislative intiatives prove it all too well. Sadly, he has a commie democrat party in power who lust for what they perceive as a socialist paradise they believe he is working for. They are fools and he is working to destroy their playground, not change it into their imagined paradise.

I don't know about his passport or if it's been validated that he even has one. But got the following link of the days activities and you can read the activities that occurred. At one point Orly wanted to call him [Smith] to the stand but wasn't allowed to. Here's another report of that activity:
Judge David Carter, though, didn't seem to want to allow any theatrics in the courtroom other than his own. Today's hearing was largely about procedural matters, not the merits of the case, and Taitz had given zero warning to the defense that she would be attempting to call a witness. Taitz begged with him to overlook that fact. Other people who had the potential to expose Obama had turned up dead, she said. She herself had faced death threats. "If, God forbid, something happen to this witness, we'll have his testimony today," she said.
Did anyone notice how stressed Obama looked today during his speech? I wondr if this had anything to do with it? Almost makes me want to watch him for a few days.
My deepest condolences. Try to have faith for that is all we truly have.
Nakazato is Carter’s exit strategy should the case become more than he wants to handle. He can always let Nakazato severely limit Orly’s options and bring the case to a squeezed end.

That wouldn't be malfeasance, it would be incompetence.
His speech was before the hearing. That doesn’t mean he wasn’t nervous about the potential results of the hearing.
I don’t see how the hearing could have really gone much better for the plaintiffs.
Well, Chinslurp will say anything to make Obama look legit, even if he has to pull it out of his rear end.
I doubt Clinton even knew/knows who he is. Besides, he was rather preoccupied during most of his presidency.

But, there’s plenty of good news on the entertainment front. In 25 years of practice, I’ve never heard a judge (or even heard about a judge) tell to two lawyers, on the same side, to “push their chairs closer together” - in open court, no less. C’mon, that’s comedy gold and surely a story to be told to every 1L in the country.
