Yeah...I think that Adolf H. has some problems but should be given a “good hearing” before we decide to filbuster or not.

The over/under for the confirmation is 88 votes.....

I'll take the over. ...especially when considering Ginsburg's 96.

I kind of think a few Republicans are tired of getting kicked around, and since they are in the super minority, they will should a tiny bit of backbone when it is completely meaningless.

I agree. And by doing so, she displayed her lack of standing to be placed on the SCOTUS. She’s just in over her head, even at the level she’s at now. She should be removed from office rather than be promoted.

Now where did I put my spine?

Welcome to the real world, where elections have consequences. In politics, when you beat the crap out of your allies, sit on your hands rather than vote, and otherwise engage in self-destructive behavior, don't expect your side to have any power when the chips are down.

Oh, by the way, whatever happened to that huge cause celebre of just about 18-24 months ago, illegal immigration? Did it ever occur to y'all that you're very easily manipulated into turning against your own side?

I don’t know that a filibuster doomed to be stopped is worth it.

Okay...so I read the above. I listened to Rush today, as per normal. I ponder.

First something in my head says that this woman should no more be a supreme court judge than me. I'll go a step further and say that I'D make a better supreme court judge than her. Based on the fact that I've got enough sense to know a judge's job is to interpret the law and that a white man, hispanic woman or blue martian don't matter and identity politics doesn't belong on the court.

So the pubs should just sit by and vote for this woman?

On the other hand, I agree with your comment. A filibuster probably wouldn't work and it's tough enough to get those blow-dried, suntanned, polished-fingernailed pubs to do much of anything that requires a)gonads b)principles and c)steadfastness.

I need to think about it some more I suppose because I don't have an answer. But for sure this woman should not receive one Republican vote...of this I am convinced.

“pick your battles” is just a code phrase meaning "Let's not do anything". It's only used when somebody else is picking a fight, and it means the speaker wants to give up without a fight.

Fighting a losing battle against this appointment will actually increase the political capital of the Republicans. But the gormless Republicans wouldn't know that. Folks won't flock to your banner if you always give up.

The GOP has been consulting the "Magic Conch"

"Ok, Magic Conch, what do we do now?"

"Nothing."

Fiction. Normally, judicial nominees are considered dead if they don’t pass committee. SCOTUS nominees however still get a floor vote regardless of the committee recommendation.

SCOTUS nominees cannot be blocked from a floor vote by committee. They go to the floor with an up-or-down recommendation.

She’s just in over her head, even at the level she’s at now. She should be removed from office rather than be promoted.

I it's called the Peter Principle. I agree with you that Sotomayor has already achieved that "special" level of incompetence.

From Wikipedia:

[The Peter Principle is the principle that "In a Hierarchy Every Employee Tends to Rise to His Level of Incompetence." While formulated by Dr. Laurence J. Peter and Raymond Hull in their 1968 book The Peter Principle, a humorous treatise which also introduced the "salutary science of Hierarchiology", "inadvertently founded" by Peter, the principle has real validity. It holds that in a hierarchy, members are promoted so long as they work competently. Sooner or later they are promoted to a position at which they are no longer competent (their "level of incompetence"), and there they remain, being unable to earn further promotions. Peter's Corollary states that "in time, every post tends to be occupied by an employee who is incompetent to carry out his duties" and adds that "work is accomplished by those employees who have not yet reached their level of incompetence".]

Filibuster should NOT be the first reaction to this nomination. Recognition of OPPORTUNITY should.

President Obama has given us the opportunity to expose his agenda with this nomination.

Mr. Obama is a very deceptive politician. He succeeds by signaling his commitment to his financial and political backers, while at the same time keeping those commitments hidden from the American public. In a nutshell, Most Americans don't agree with what Mr. Obama believes, and he knows that.

He blundered by nominating a radical judge for the highest court in the land. By throwing himself behind a person this radical, he has given us a tremendous opportunity.

We need to politely but firmly question this nominee about the views that we know President Obama wants hidden from the American people. Infanticide, gun ownership, abortion, judicial activism, you name it.

This nomination is a GREAT opportunity for us.

“Alabama Sen. Jeff Sessions, the ranking Republican”

He’s ‘rank’ alright! The only hope is a filibuster.

".... But, think of some of the folks out there that Obama could have chosen."

Want to really look at the bright side?

After this PC Judge gets on, Ginsburg and Stevens will be leaving, but Conservatives do not have those votes anyhow.

The Dems made a tactical error in letting Souter go first.

The Senate next year will make all the difference. If we are fortunate Reid will get axed by voters as will Specter. Without a pick up in 2010, we really are doomed.

Right now there is a slim chance that some good can come from all of this.

I doubt it will happen, but at lease I can hope for the next 18 months or so.
