She was initially recommended by Moynihan of NY to GHW Bush. Then she was nominated for the Appeals Court by bubba. The repubs had a hold on her nomination because they feared she would be nominated to the USSC. Trent Lott caved and allowed her to be voted on and she won with 67 votes. PUKE

Obama Supreme Court Pick Slapped Down Reverse Discrimination Case in One-Paragraph Opinion
The case, Ricci v. DeStefano, involved a group of 19 white firefighters and one Hispanic firefighter who filed suit in 2003 claiming that the city of New Haven, Conn., engaged in racial discrimination when it threw out the results of two promotion tests because none of the citys black applicants had passed the tests.
Each of the plaintiffs had passed the exam. The case is currently before the U.S. Supreme Court.
The city threw out the results because it feared potential lawsuits from activist groups if few or no minority candidates were promoted. The city also claimed that in addition to potential lawsuits, promotions based on the test results would undermine their goal of diversity in the Fire Department.
The firefighters sued, arguing that New Haven was discriminating against them by deciding that the tests would promote too many white candidates and too few minorities.
Federal Judge Janet Bond Arterton rejected the firefighters appeal, siding with the city and saying that no racial discrimination had occurred because the city didnt promote anyone at all.
U.S. Appeals Court Judge Sotomayor issued an order that affirmed Artertons decision, issuing a one-paragraph judgment that called Artertons ruling thorough, thoughtful, and well reasoned,

Absolutely, because he has no ability to pick anyone who would uphold the Constitution.
Will she get confirmed? Probably, but not necessarily. But it does not have to happen without Zero spending enormous amounts of political capital on this. If Senate Republicans can stop kissing up to the Hispanic lobby (they'll never ever vote for us, unless we're as generous with the freebies as the Rats have been) and start exploiting the politics of division (yes, that's what an opposition party does), we can use this pick as an example.
Many really stupid guilty white Americans thought that a vote for an African-American president was going to "forgive" their race for centuries of racism. They thought Barry would help smooth over the fury that angry minorities have displayed over the past forty to fifty years. Sotomayor's decision on the New Haven firefighters' case proves that the executive and judicial branches of government will still be bent over backwards to accomodate the demands of the unqualified.
We need Republicans with the testicular fortitude to slam hard on this, and other such views of this would-be writer of laws, and show the really stupid people that they were being sold sizzle, and not steak when they voted for Lord Zero.
We may get stuck with this lousy woman as a Justice, but if it costs Obambi his second term, it might be worth it.

Tim O’Brien was telling Bill Hemmer that Barry wants a judge with a heart...ah, how sweet. But even Chuck Schumer says Justices must apply the Constitution and not go by their feelings. Tim says if that’s the case, she will not be confirmed. If she says she does not like the law, she has very serious problems. Tim thinks that if the Senate can’t vote by September and she’s out taking pot shots, this pick was premature.
Yep that affirmative action case will be the most controversial.
