I’m not surprised. Since when has any branch of our government upheld the Constitution? Not for many, many years.

It’s not about what you believe. The laws are not set by what some blogger named Bronxboy “believes”. The laws are there. You can refuse to believe their existence or not.

I think I have already sent you the law requiring her to be older than 18 to transfer citizenship.

And yes, if millions of Americans were born between 1952 and 1986, and one married parent was not a citizen and one parent was only 18, then they would not be citizens.

If they were born after 1986, in order for citizenship to transfer, the one US citizen parent would have had to have lived in the US for 10 years, at least two over the age of 14.

Agreed that if he was born here, it’s irrelevant.

You obviously have not finished your homework assignment. You’ve been freeping and expressing your thoughts and feeling.

Now getting back to logic and reality. When you’ve finished reading the court document for the 24 hours assigned on sight below regarding the last question you asked, we’ll talk about the next issue: His mother’s transfer of citizenship (I’ll even post the actual law that explain her inability to transfer citizenship because of age.)

Excellent analysis regarding the desire for some to want this to go away. If the “smart people” don’t tell them it’s a big deal, it’s no big deal.

That’s a problem here now, people have lost the ability to think for themselves. And when they encounter someone who does, it’s easy to fall into mocking them.

From the article you reference:

Before the election, Fukino issued a statement saying that she and the registrar of vital statistics had personally examined the birth certificate and found it to be valid.

That was a stement she made before the case, NOT a statement she made in court. Ans they Advertiser got the statement wrong. Notice they are not quoting her.This is where they got the statement from and this is what she actually said :

When the birth certificate arrived from the Obama campaign it confirmed his name as the other documents already showed it. Still, we took an extra step: We e-mailed it to the Hawaii Department of Health, which maintains such records, to ask if it was real. “It’s a valid Hawaii state birth certificate,” spokesman Janice Okubo told us.

They conveniently left out what she went on to say :

“When we looked at that image you guys sent us, our registrar, he thought he could see pieces of the embossed image through it.” Still, she acknowledges: “I don’t know that it’s possible for us to even say beyond a doubt what the image on the site represents.”

So they can't confirm that the copy posted on the site is a legitimate copy.It may resemble one, but it can't be authenticated .

I suggest next time when you make staements you look at the original source of the staement and not a second-hand comment about it

All citizen born on American soil are “CITIZEN” Natural born citizens must have been born here and have TWO parents who are also citizens. The POTUS is the only person required to have this status......

Thank you hoosiermama, good point about the Natural Born vs Citizen issue.

I wish there was a more legal explanation. Has this ever been explored in a court?
Just curious.

Turns out that President Chester Arthur faced exactly the same problem: his qualification for President was challenged pursuant to a circumstantially questionable birth certificate.

Yes, Donofrio did not base his case on where Obama was born.

I've seen good arguments from both sides regarding the issue on natural born citizen and how it relates to having one alien parent, yet, the child is born on US soil. I do not think that it has been defined conclusively in law, when applied to eligibility for POTUS. If it was, we wouldn't be reading the thousands of posts that exist on hundreds of threads, where two different trains of thought about the NBC issue continues to be debated without end.

I believe that the framers of the Constitution wanted zero influence, allegiance or loyalty from a foreign state, in regards to the U S Presidency. My impression is that they set the bar as high as they could; birth on U S soil and birth to two U S citizens.

I'm pretty well burnt out on the back and forth arguments. I plan to stand down until the SCOTUS gets involved. Drive on! ;o)

We should print up T-shirts, bumperstickers, what-have-you with a catchy slogan e.g. “Don’t you DARE ask ME for MY birth certificate” or some such. Also print up little round stickers with something more abbreviated (like “FU”) to put on any form that asks US for a vault copy of our BC. There are opportunities here for entrepreneurs, plus we make our displeasure known.

Hey: I looked it up and found three independent news sources for what I quoted. That is all most of us have to go on. I have not seen or heard the original statement, but would greatly appreciate if you could supply a citation for what you are quoting here. Thank you in advance.

It's not that I don't believe you; in fact I'm guessing that you have the source at your disposal. Beyond that, I think you need to acknowledge that it is a bit of a leap to say that because a document cannot be finally authenticated from an on-line image, that it is not in fact genuine.

So I'll go back to my original point, which was that I have yet to see proof one way or the other, and that we need to be cautious about making claims regarding the falsehood of a document which under other circumstances would be given at the very least a presumption of legitimacy.

All are types of citizens, it would appear.

An “anchor baby” may be a citizen, but he or she cannot be president.

John McCain was not native born, but he was natural born (two U.S. citizens were parents).

Right! Here we are arguing the BC, when Donofrio’s case was re the NJ Sec/State sidestepping the laws! If this was clear-cut why did the Court deny it?

I have a theory: The NJ law may not actually stipulate the extent to which the SOS there must verify the qualifications. It could very well be written in such a way as to permit the very practice that most of the states -- if not all -- are using: trusting the political parties to have vetted their candidates.
