Jeez, is the guy even in the ground yet? Quite the laundry list of defendants in this case. They're sure to hit the jackpot with this shotgun approach. Yes, it was a terrible incident, and I don't mean to sound callous -- but it happened five days ago.

Wal-Mart likely has legal liability, but I still insist that the fault lies with all the animals who rushed through the doorway.

It's pathetic that all the talk immediately after the incident was focused on liability and the possibility for a lawsuit. What a country. I think no one is at all surprised.

Wal Mart should not be sued. The dirtbags that broke through the doors should be brought to justice. I am sure they are on camera. But those dirtbags don’t have the deep pockets that Wal Mart has, nor would it be politically correct to bring the real perps to justice for fear of riots.

I normally stick up for WM and against lawsuits but I can see where WM created the situation, even though that is hindsight and it hasnt happened before this. I think that means WM will settle.

I heard on the news today that the owner of the venue (Wal-mart, in this case) is responsible for crowd control. They didn't do it.

Once again, we wouldn’t want to hold the animals ACTUALLY responsible for killing the guy responsible. Instead, go after the nearest peripheral party that has money, and give the animals a pass. Not only does this not hold those directly responsible accountable for murder, it encourages this sort of primal behavior in the future, since it leads to rich payoffs & no consequences.

Perhaps in order to offset the costs of the frivolous nature of this disgusting excuse for legal activity, we could all shop at Wal-Mart tomorrow?

Lawyers for the family of a worker trampled to death in a "Black Friday" crush of bargain hunters at a Long Island Wal-Mart store filed a wrongful-death lawsuit on Wednesday, claiming store ads offering deep discounts "created an atmosphere of competition and anxiety" that led to "crowd craze." Lawyers are hoping for a hefty payout, but do plan to give token amounts to the grieving family.

He has barely cooled off yet.
He was 6'5’’and 270 lbs. and I don't understand how he got crushed and the people pushing him did not. There could be a health issue. The people forcing their way in are responsible, but in other cases more than one got hurt or killed.

If he is a Wal Mart employee, then Wal Mart should be exempt from any Civil suit by the family under the Workers Compensation Laws of the state.

Generally workers compensation is the sole and exclusive remedy against an employer by the employee or his family for injury or death. There are exceptions, but they are rare and I don't think this would qualify.

Perhaps the solution is to announce 24-hours-per-day shopping starting the Tuesday before the Thanksgiving holiday. Any special sales pricing could then commence on Black Friday morning. Consumers could arrive whenever they wish with minimized fear of crushing. People who really desire a discouted television, junky bicycle, or Wii game system could gather their purchases beforehand and simply await for the cash registers to reflect the new sales prices at the prescribed time.

I am surprised that no one has blamed the real villians: Bush and Cheney. They created this terrible economy that forced Walmart to offer these very low prices that caused these animals to stampede. Maybe the local prosecutor can indict them.

Maybe Wal-Mart shouldn’t have Black Friday sales at this location. Oh wait a minute, if they did that they would be called racist and be sued just the same. Oh who cares anyway, it is fn’ Wal-Mart. From my years of brainwashing I am told they are evil. We should want them to get sued for something that isn’t their fault. We should want them to have to pay. Who cares of these neanderthals are making stuff more expensive in the stores. Papa Doc 0bama will make it alright for us. He will take money from all the rich peoples side of the bucket and give to little people so we can afford stuff at the new Wal-Mart.

This is another case where people say, "I agree the judicial system is out of whack, being abused, but in THIS case..." etc, and parasite shysters like John Edwards get rich! It's a criminal case and Wal Mart has no liability here, none!
