Obama Fomenting A Constitutional Crisis: Constitutional Lawyer Discusses Ramifications

Controversy continues to surround President-elect Barack Obama's eligibility to serve as president, and a case involving his birth certificate waits for its day before the U.S. Supreme Court. A constitutional lawyer said were it to be discovered that Mr. Obama is not a natural-born U.S. citizen, it would have grave consequences for the nation.

According to the Constitution, a president must be a natural born citizen of the U.S. Mr. Obama's critics have failed to force him legally to produce his original birth certificate, and Mr. Obama has resisted any attempt to make him do so. Currently, only Hawaii Department of Health officials have access to Mr. Obama's original records.

Some of Mr. Obama's critics have said he was born in Kenya and have claimed he is a citizen of Kenya, Indonesia, or even a British subject.

Edwin Vieira, a constitutional lawyer who has practiced for 30 years and holds four degrees from Harvard, said if it were to be discovered Mr. Obama were not eligible for the presidency, it would cause many problems. They would be compounded if his ineligibility were discovered after he had been in office for a period of time.

"Let's assume he wasn't born in the U.S.," Mr. Vieira told The Bulletin. "What's the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can't make him president. So what's the next step? He takes the oath of office, and assuming he's aware he's not a citizen, then it's a perjured oath."

Any appointments made by an ineligible president would have to be recalled, and their decisions would be invalidated.

Besides that, look at his military record. If the military accepted him??? Then why not us??

I agree with 100%. Over on the other side democrats kept the moonbats locked up so they could win, but they did keep them angry too. I am hoping this is just temporary with the lame duck congress and GWB post election frustration, and next year when real issues appear they will be the focus. (actually the UAW bailout and GA senate race are right NOW and should be main issues)

When I tell them to have fun even though its not going anyplace they get pissed over that too.

McCain wasn't born in a military base, he was born in a civilian hospital in Panama. His natural born citizenship status comes from his parents.

Besides that, look at his military record. If the military accepted him??? Then why not us??

You would have to ask all those people who voted for Obama.

I would think Congress and the courts would have little to fear from the IRS, etc. They would do well to consider the sting of the people.

I think it would be a matter of legitimate public concern — after all look at the level of scrutiny Obama himself feels is necessary to vette any who work for him — so it is curious Obama hasn’t requested all those public records be made available to the public.

However, the Governor stepped in an sealed the file a month ago. Creating a fraudulent document would not be as easy as is assumed.

Birth on national soil is not a prerequisite of Natural born. There are only two kinds of citizens not some third hybrid.

Birth to officials on government duty grants Natural birth.

The issue with Natural born is allegiance not geographical location of birth. Donifrio’s case just muddies the water and aids Obama.

You are incorrect. IF BO was a Natural born citizen he and only he must renounce that citizenship before any other allegiance is formed which would preclude him. IF he was born in Hawaii then the other stuff matters not as long as he did not affirmatively as an adult renounce his citizenship.

According to the Italian consulate, submitting the proper documents would cause them to "recognize" my Italian citizenship, not "grant" citizenship. It's a jure sanguinis situation.

If it is not recognized right now, then submitting those documents by you would come at a cost to your current citizenship in one way or another, just like Obama's submissions to renew his Indonesian citizenship/passport would have been at the cost of his US citizenship, that is, if he ever actually had it.

He [McCain] is a natural born U.S. citizen because both his parents were U.S. citizens who had resided in the U.S. for some time prior to his birth.

Something that cannot be said of both of Obama's parents.

Exactly who in the DNC and on the hill does the required vetting re: candidates? What’s the process and who’s responsibility is it?

Can individuals re: process be issued subpeonas?

I can’t say if the DNC or RNC are responsible to make sure their candidates meet constitutional requirements. But each Sec of State is suposed to make sure the candidates for President and Vice President meet constitutional requirements BEFORE their names can be placed on the ballor of their states. That is my understanding.
