Not really; the election can be ruled illegal anytime. If it was illegal, it was illegal, regardless of when it’s determined that it was illegal. Even if it’s after January 20, it’s not too late. He’d simply not be the POTUS because the election was declared illegal. It’s against the law to run unqualified candidates; it’s against the law to swear in unqualified candidates; it’s against the law for electors to vote for unqualified candidates — the law in all these cases being the Constitution itself.

That’s a complicated question. If Obama is found out as a person ineligible to serve as president, it depends on when he’s found out. If it’s before the Electors pick him as the president, the Democratic Party picks a new person and it could very well be Hillary. If it’s after the inauguration, then he resigns and Biden is the new president.

If it happens between the Electoral College and inauguration day, I’m stumped. My guess is that it would still be a decision by the DNC.

Based on the premise of the original post, which sumises at some future point that the Supremes have found the document to be false and Obama to be a non-citizens, your questions of fact based on the (so far) fictional event would be totally moot. All those things would be known by that point, or, there wouldn't be any Supremes ruling.

If he was - in fact - found to have been born in Hawaii...the whole argument will be moot, and everyone will shut up and go home.

However, if the certificate is found to be fake, and ruled as such by the Supremes, then there would not only be eligibility questions, there would also be questions of fraud and criminal intent to be investigated.

But, so far, this is all based on conjecture and a speculated event, so neither my arguments nor yours are worth debating.

Technical, technically you are right but the date of Dec. 15, 08 has a very important event associated with it - the meeting of the Electoral College to cast their votes. It would be most advantageous to have the scenario happen then or even before the joint session of Congress on Jan. 8, 09 rather than eleven months into an entrenched Obama Administration.

If by chance Obama is found ineligible to be president...how would that affect Joe Biden...the choice for VP would have been made by someone unqualified to make the decision...so how could he possibly take the place of president? Just wondering...

SCOTUS will accept the case if some of the evidence rumored to exist really does exist—my take. They have to because if he's illegal, every action taken be him can be litigated—there would be no Presidential Shield from litigation. The internet rumors need to be verified.

On the surface, I’d rather have Biden than Hillary. He’s an affable bumbler and doesn’t have the same mafia-like political machine behind him.
