The California secretary of state should refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until President-elect Barack Obama verifies his eligibility to hold the office, alleges a California court petition filed on behalf of former presidential candidate Alan Keyes and others.
The legal action today is just the latest is a series of challenges, some of which have gone as high as the U.S. Supreme Court, over the issue of Obama's status as a "natural-born citizen," a requirement set by the U.S. Constitution.
WND senior reporter Jerome Corsi even traveled to Kenya and Hawaii prior to the election to investigate issues surrounding Obama's birth. But his research and discoveries only raised more questions.
The biggest question is why Obama, if a Hawaii birth certificate exists, simply hasn't ordered it made available to settle the rumors.

I read this earlier, and the story seemed to suggest that Hussein spent much of his childhood in Indonesia w/long separations from mother (communist ideology: work/teach for the common good, put other peoples’needs before your own (trusting that others will raise your kids just as well as you could, etc)—) Strange that only 2 libraries in the country have this & that it was not brought out by 0’s brain trusts during the campaign. No, not strange! They wanted as little mention of Indonesia or Kenya as possible.

Yes I do see it as black and white. Having done extensive study for the last decade on the Founding and Founders there is no doubt in my mind that they considered alligiance as the most important aspect of “Natural Born”.
It would be a complete violation of their ethical view had children of citizen agents of the state been excluded from full citizenship.
It simply makes no sense which is why this case is a distraction and destructive of the need to expose Zero ineligibility. I have no confidence in this guy’s motives if he is willing to ignore such a basic concept. Only Obama will profit from this distraction.
The Founders did not exclude citizens born abroad only those who had not been in the colonies for 14 years prior to the ratification i.e. 1773. I call this the Hamilton Clause since it made him eligible.

It is sad. Saw the original movie on TV years ago, was good but I can’t remember who played in it. There was a remake in the ‘8os & usually the orig. is best, haven’t seen the new one.

I still support Leo for what he is trying to do. I hope his case along with other cases will make sure that our Constitution must be upheld. Whomever holds the Office of President must meet the Constitutional requirements!

I agree with you that it is clear that the Founding Fathers considered allegiance as being significant. Since you have done a lot of research on our Founding Fathers, perhaps you can answer a question that has been on my mind through all of this. At the time of our Founding Fathers didn’t they also believe allegiance was only passed down through the father and not the mother?
I have never seen that issue addressed but, given the fact that the Constitution is written in an entirely gender neutral format, I would hazard a guess that the answer is “No.” Now that is not a claim they were feminist but it is, nevertheless, quite interesting.
The only Revolutionary leader that I am aware of who had a major female intellectual influence is John Adams through Abigail. They seemed to be so complimentary that it would have been a great loss when not together.

The analysis of natural born citizen found on the web page is quite good and also does address my question to you about how the Founding Fathers looked at the citizenship of the mother. In summary, the citizenship of the father was what was considered to be inherited by the children, however it goes on to state that both parents had to be citizens and born on U.S. soil to be natural born.
A very good read that seems to substantiate Donofrio’s claims.

Thanks for the link. My summation is that there are several areas of interest in it which are of interest.
1) There is no controversy over the fact that the Framers based their legal theory on English Law. The concept of Natural born is one such definition which, though it is not identical to, is based on Blackstone.
2) Much of the article is of little regard here but essentially the author’s argument leds to the conclusion that McCain is a Natural born citizen. He makes a big point about a potential “double allegiance” something not applicable to the son of a military family. There is no double allegiance in such a case.
3) King’s comment which is quoted that one who is a “member of the body politic” has allegiance to that body. This also affirms that McCain is eligible being born to citizens in service to that body politic.
4) I do not agree with the description of the reasons for the War of 1812. Impressment was only one issue.
5) Certainly military families are subject to the jurisdiction of the US government and McCain owes no allegiance to any other country.
6) St. George Tucker is quoted misquoting the constitutional requirement as “native born”. It is interesting to note that Kingdoms were not even constrained to take their Kings from native or natural born subjects hence William of Orange was from the Netherlands and the Hanoverian dynasty came from Germany.
7) This article does not support Donofrio’s argument against McCain’s eligibility at all. In fact, its arguments make it clear that he is eligible.
