That will only have bearing if Obama is not thrown out as the “President-Designate” prior to the EC meeting to decide the “President Elect.”
If Obama is thrown out before then, all bets are off. States could meet to appoint EC representatives as they saw fit to go to the EC meeting. My bet is that McCain would get his minimum 270 Electoral votes to be President, but then his own “natural born” issue would be challenged.

Bush knows when Kim Jong Il sneezes but he can't find out if Obama is eligible to become President? Under California law, any citizen has standing to demand by what authority any government action is taken. So it’s a quicker way to push to resolve the Obama BC/ Natural born citizen issue.
That is correct, the EC hasn’t voted as of yet. But when they do and if the vote for the Democratic Ticket then we’ll have an President/VP-elect. Thus Biden will be vp elect and in line to act as President if Obama is out as failing to have qualified.
Then what are you going to do about the EC votes bound by state law to vote for the Democrat Ticket?...... They aren’t going to vote for McCain much less Barr which is the one I”m referring to in your original post as the person to become president..... [the Libetarian candiate, Barr, could be said to be the rightful president. ]
