Obama's birth certificate sealed by Hawaii governor

HONOLULU, Hawaii – Although the legitimacy of Sen. Barack Obama's birth certificate has become a focus of intense speculation – and even several lawsuits – WND has learned that Hawaii's Gov. Linda Lingle has placed the candidate's birth certificate under seal, and instructed the state's Department of Health to make sure no one in the press obtains access to the original document under any circumstances.

I’m at a loss why he refuses if there really is an original birth certificate. If his refusal changes even a few hundred thousand votes, he will lose. No matter how it is spun, his refusal to have it released (again if it exists)is a concern to some middle of the road people.

The governor of Hawaii has done a great service. She has focused attention on all this turmoil regarding his birth certificate. By pointedly notifying the world that the BC is under seal she has raised the level of agitation about it.

Even some really moribund news organizations may start to wonder about it.

Even if someone other than Barack Obama Sr. was the father, who ever filled out the form at the time of the birth was under no obligation to put in a different name, or any name for that matter. I would guess that wherever the birth took place, the name on the document is that of Obama Sr.

The more I think about it, the more I like this decision. The Gov is doing her job AND it gives the GOP/McCain camp fodder when the O-bots scream “prove the BC is fake” Well, know one has the actual BC, and what is out there from HI is now under seal so,,,,

It is now up to Obama to get it released. If he has already released a forgery, he can’t demand the release of the authentic doc, then they could be compared and his scam would be found out. So, he is stuck. If he didn’t have anything to hide, he would announce that he is requesting a copy and discuss the custody of it so that it can be authenticated the second it gets out of the state’s hands.

A certified copy of a vital record (birth, death, marriage, or divorce certificate) is issued only to an applicant who has a direct and tangible interest in the record. The following persons are considered to have such an interest:

• the registrant (the person whom the record is concerned with);
• the registrant’s spouse;
• the registrant’s parent(s);
• a descendant of the registrant (e.g., a child or grandchild);
• a person having a common ancestor with the registrant (e.g., a sibling, grandparent, aunt/uncle, or cousin);
• a legal guardian of the registrant;
• a person or agency acting on behalf of the registrant;
• a personal representative of the registrant’s estate;
• a person whose right to obtain a copy of the record is established by an order of a court of competent jurisdiction;
• adoptive parents who have filed a petition for adoption and need to determine the death of one or more of the prospective adopted child’s natural or legal parents;
• a person who needs to determine the marital status of a former spouse in order to determine the payment of alimony;
• a person who needs to determine the death of a nonrelated co-owner of property purchased under a joint tenancy agreement; and
• a person who needs a death certificate for the determination of payments under a credit insurance policy.

Will any of the states where lawsuits are filed, other than Hawaii, be considered "a court of competent jurisdiction", other than the U.S. Supreme Court?

The intent of common seems to be a closer relative after seeing what was in the parentheses.

The governor is following law as she should. Would that more were so conscientious about following the law even though it might be in their party's best interest to do otherwise.

We'll have hope there will be a legal solution for him to prove he's eligible.

Cheney is not a common ancestor, only a cousin to the nth degree. I have a common ancestor with Obama way, way far back in pre-medieval England. The relationship has to be closer.

I've been stymied in my genealogical research by these laws, but abide by them.

That’s just an opinion in an area of unsettled law. There are other opinions — and more valid ones. The 14th did NOT change the old common law definition of “natural born”, sorry.
