Obama is "NOT" qualified to be President of the United States Lawsuit Against Obama Dismissed from Philadelphia Federal Court

(Lafayette Hill, Pennsylvania – 10/25/08) - Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that he is immediately appealing the dismissal of his case to the United States Supreme Court. The case is Berg v. Obama, No. 08-cv-04083.
Berg said, "I am totally disappointed by Judge Surrick's decision and, for all citizens of the United States, I am immediately appealing to the U.S. Supreme Court.
This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?
So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.
According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

We must legally prevent Obama, the unqualified candidate, from taking the Office of the Presidency of the United States,” Berg said.

Moreover, the evidence now suggests that Obama's mother may not even have registered him as a US citizen before he moved to Indonesia. That would make him an Illegal Alien who cannot even hold his current Senate seat.

When I was cleared for Top Secret, codeword clearance, the FBI was out asking everybody I knew, all about me. I still find this amazing that no agent was out talking to The One’s “minister,” his board member associates or any of the other shady characters this guy runs with.
I had to fill out form after form about my young life (at the time) and was really sweating it because my father-in-law was still a Lithuanian citizen (became a citizen on July 4, 1976) and had plenty of family members still living in the Baltic States and in Moscow. Back in the Cold War era, having relatives behind the Iron Curtain was enough to have you fail the background check. Since the old man was not really my relative (”He’s my wife’s father, not mine” I said as I threw him under the bus), I was hoping that would give me a pass.
It worked, and I went on to bigger and better things, but I still can’t see how the Kenyan made muster.

Makes sense. If everyone remembers correctly, Novak had inside information that the Clinton camp had very damning material on the opposition but refuted it and never released it. Wondering if this is what their smoking gun was.

There are suits in Ohio, Virginia, Wisconsin, Hawaii and a few others. Look at the posting from Newsmax. All the states are listed where suits are taking place.

Washington.California,FLorida Georgia, Pennsylvania, Newyork, Connecticut, Ohio’s are all similar to Berg’s. Hawaii’s suit is a freedom of information asking to produce the BC.
Had a thought this AM concerning standing.....Since the Constitution doesn't state who has authority to determine if a candidate is eligible, and no case has been brought to it previously regarding eligibility, there seems to be no precedence to determine standing. Your thoughts?

That is not what the Constitution says--the language is "shall not be eligible to the office"; a person who is not natural born is not eligible to act as President.
And running isn't injury--how is Berg or anyone else hurt by the fact that someone is running for President? Direct injury getting standing is where the person gets elected and can and does take action that damages your economic or personal interest or assets in some fashion. Even then, there is room for argument.
If you really want to try to understand operation of the standing issue and how someone might have standing, you should read the Michigan Law Review articles.

IF said person is a ‘fraud’ then is not injury caused by the act of voting for a ‘fraud’. IF one has the right to vote how can another have standing to take that right away?
