Case Summary
Plaintiffs filed their class action lawsuit on July 6, 1994, alleging that Citibank had engaged in redlining practices in the Chicago metropolitan area in violation of the Equal Credit Opportunity Act (ECOA), 15 U.S.C. 1691; the Fair Housing Act, 42 U.S.C. 3601-3619; the Thirteenth Amendment to the U.S. Constitution; and 42 U.S.C. 1981, 1982. Plaintiffs alleged that the Defendant-bank rejected loan applications of minority applicants while approving loan applications filed by white applicants with similar financial characteristics and credit histories. Plaintiffs sought injunctive relief, actual damages, and punitive damages.
U.S. District Court Judge Ruben Castillo certified the Plaintiffs suit as a class action on June 30, 1995. Buycks-Roberson v. Citibank Fed. Sav. Bank, 162 F.R.D. 322 (N.D. Ill. 1995). Also on June 30, Judge Castillo granted Plaintiffs motion to compel discovery of a sample of Defendant-banks loan application files. Buycks-Roberson v. Citibank Fed. Sav. Bank, 162 F.R.D. 338 (N.D. Ill. 1995).
The parties voluntarily dismissed the case on May 12, 1998, pursuant to a settlement agreement.

What was the settlement? CitiBanks agreement to make loans to people who demographically were at high risk of foreclosure?
That would be a nice little firecracker for McCain to throw at Obama tonight. I wonder if they have an answer for that one. Probably “I was just a hired lawyer doing my job” or some silliness.

The sad thing is that will be his legacy statement if elected.
If this was from way back in 94, wouldn’t you think that foreclosures would have been happening much sooner than 14 to 15 years later? I say that a very big part of this is the over-extended second mortgage holders that were trying to play the game with the ARM rates and lost.

1. It’s not racist to point out that these suits and government policies wrecked our economy.

The settlement was reached in May 1998.
Assume Citibank began issuing loans to poorly qualified applicants in 1999. Assume they issue 5-year balloon loans or ARMs that begin to go into default in 2004.
Entirely plausible that this lawsuit contributed (significantly) to the current mess.

I don’t expect McCain to lob any bombs that haven’t already been floated past the Media to see how well they’d play. The ‘undecideds’ might not know how to evaluate Obama’s reaction if they’d never heard it themselves.
