Barack Obama is not legally a US natural-born citizen according to the law on the books at the time of his birth; a law that was in effect between December 24, 1952 and November 13, 1986, when the law was changed.
However, the new law did not preempt the former law in the cases of those born between the above listed dates when the old law was in effect.
Therefore, Senator Obama may very well be disqualified....
Barack Obamas father was not a US citizen, and Obamas mother was only 18 when he was born, which means although she had been a US citizen for 10 years, his mother fails the test for being so for at least 5 years prior to Barack Obamas birth.
In order for her child to have been a natural-born US citizen, his mother would have had to be 21 at the time of his birth....

A win is a win is a win. If he were to get elected and it came out AFTERWARD that he wasn't even qualified to be elected, you would FIRST IN LINE to scream "HEEEEEY! WHY DIDN'T ANYONE BRING THIS UP AND DO SOMETHING ABOUT IT!"
He needs to be beaten by any (legal) means possible. This is not a friendly game of golf where disqualifying someone because they didn't sign their scorecard would bring scorn. This determines the leader of the free world.
What nonsense. He was born in the US.
This has been discussed here ad nauseam (key word certifigate). The point is whether he was born in the U.S. or not. If he was then he’s natural born. If he was born overseas then, based on the above criteria, he’s not.
Hawaii wasn't in the U.S. when Osama was born...I guess that makes no difference tho...
If the Clintons try to play this on Barry O at the convention, there’s going to be a blood-bath in Denver. Perhaps literally.
Hawaii entered into statehood August 21, 1959...
Two years prior to NObama being born....
U.S. law doesn't matter? Is this what you're saying? It's people like who don't care enough to keep and fight for traditional standards so we don't have to put up with these liars and selfish prick secularist who want to destroy the country.
Of course it matters, it's the law!
This whole birth thing has been brewing for a long time. It has already been determined that the birth certificate was forged and the person who did it, finally admitted to the fact.
Barry Goldwater was born in the Territory of Arizona before it became our 48th state ... he was qualified to run for president (and too bad he didn’t win).
US Law very clearly stipulates: If only one parent was a US citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16.
Barack Obamas father was not a US citizen, and Obamas mother was only 18 when he was born, which means although she had been a US citizen for 10 years, his mother fails the test for being so for at least 5 years prior to Barack Obamas birth.
In order for her child to have been a natural-born US citizen, his mother would have had to be 21 at the time of his birth.
In essence, Mrs. Obama was not old enough to qualify her son for automatic US citizenship.
His mother would have needed to have been 16+5 = 21 years old at the time of Barack Obamas birth for him to have been a natural-born citizen.
Barack Obama instead should have been naturalized, but even then, that would still disqualify him from holding the office of President under current law.
At best, Barack Obama is only a naturalized US citizen.
This is an issue that must be clarified before the election.
The last sentence says it all. Why didn't anyone south of the border pick up on this.
I suppose that Barry is in Hawaii to get a copy of his mother's birth certificate from his grandmother to have time to photoshop it to show his mother was 21.
I think timing after the election would be wrong. IMHO, she take the VP nomination, then in Sept. or Oct. she pulls the trigger on him. He gets disqualified before the election and she humbly takes the nomination. If she waited until after the election he would be a seated president and the legal machinations would take years and he still might not be removed from office.
Irrelevant. The consideration is that the father was not a citizen so, in order for the child to be a natural born citizen the mother must have been a citizen for 10 years at least and 5 of those after reaching the age of 16. Actually I think this all depends on the child having been born outside of the US and its territories. Without a real birth certificate, and given the other circumstances there is some question about that.
I get it now, depressed. Thanks so much.
Ok that is a vision I did not want in my head, thank you!! /sarc
Yes, thank you, arthurus. depressed in 06 clarified this for me. It seems to be an issue.
He is certainly not qualified in the larger sense. It appears that he fails on the technicalities as well.
However, I wonder if there is any legislative history that would indicate that this was meant for parents that were naturalized citizens rather than those who were born citizens. I don’t know the answer. Just thinking.
I am still trying to identify this guy. He was a TV type back in the 50’s-60’s! HELP
[Why didn’t anyone south of the border pick up on this.]
This has been discussed in exquisite detail a number of times, all with no factual basis to conclude his ineligibility.
But B.O. is a citizen of the world!
You are not reading the entire law as quoted in the article. If only one parent was a US citizen at the time of nObama's birth, which was true, his Mom must have resided in the United States for at least ten years, at least five of which had to be after the age of 16. My emphasis added to show you what you have missed.
Mama nObama was only 18 at his birth, thus he, according to this, is only a naturalized US citizen like Schwarzenegger.
Of course, even if this is 110% correct, the MSM will ignore it completely. Even if nObama is caught with a dead girl and a live nine-year old boy in a cheap hotel bed shooting up heroin, as far as the elite liberal media thinks, the big fix is in!
