A Hint of New Life to a McCain Birth Issue

In the most detailed examination yet of Senator John McCain’s eligibility to be president, a law professor at the University of Arizona has concluded that neither Mr. McCain’s birth in 1936 in the Panama Canal Zone nor the fact that his parents were American citizens is enough to satisfy the constitutional requirement that the president must be a “natural-born citizen.”

The analysis, by Prof. Gabriel J. Chin, focused on a 1937 law that has been largely overlooked in the debate over Mr. McCain’s eligibility to be president. The law conferred citizenship on children of American parents born in the Canal Zone after 1904, and it made John McCain a citizen just before his first birthday. But the law came too late, Professor Chin argued, to make Mr. McCain a natural-born citizen.

“It’s preposterous that a technicality like this can make a difference in an advanced democracy,” Professor Chin said. “But this is the constitutional text that we have.”

Excellent question.

A man who presents himself to be the leader of this nation would offer without request his eligibility as a citizen would he not? Why should we be asking for it? With no response from him?

There are very few citizens in this country who cannot produce a valid birth certificate within days - and certainly can within a month.

I agree - for all we know, his communist Mommy and African daddy rejected America, and BHO was born in Africa. Not a far stretch. What about Brangelina’s little girl. She was born in Africa so that her mommy could have better medical care. Does that mean little Shiloh isn’t an American citizen???? Oh, the humanity...

The Times gives national prominence to the ruminations of a quack law professor (I am an adjunct professor of law myself) who suggests Senator John McCain is not eligible to be president because his father was serving in the U. S. Navy in the Panama Canal Zone when the senator was born. Professor Gabriel Chin’s legal theories are loopy. But they trigged a different response with me. I immediately had questions about unbalanced coverage and media bias.

We shall see if the lofty NYT gets around to asking the Lord Messiah Obama for his, and John Kerry for his military records, while they're at it.

I think your take is absolutely right. I really don’t believe all the Nobamasiah hype the press is giving us, with poll after poll of Nobama leading. I’m sure a lot of people say they’re voting for Nobama because I’m equally sure the follow up question to a “no” answer is to ask if it’s because he’s black. Who needs the aggravation?

I’m also pretty sure these polls are being done in urban areas. “A sample done across the U.S.” probably means S.F., L.A., Chicago, New York and Boston.

An excellent point! I made a $50 bet with my daughter during Operation Chaos that the Clintons would never let this novice become the RAT nominee. Of course she would like me to pay-up now but I refuse until after the August convention. One underestimates the Clintons at ones own peril.

Isn’t it amazing that, in the most successful and talented country in the world, we have two people running for President who are arguably: a) the least-qualified for that office in our nation’s history; and b) neither may be eligible for that office.

Only in America, folks! And when can I start disregarding laws?

That is no delusion. I would conservatively estimate that at least 75% of this country's news reporters, editors, producers and directors intend to vote for Obambi, and that number might be as high as 90% by November. He is their Muse, the repository of all Hope, the Patron Saint of Blessed Change, the wind beneath their wings. Just look into the reporters' eyes at any daily Barack Love-in masquerading as a "news conference". Where normally you'd only be able to make out the back of their empty skulls, these days you will witness a sea of glistening eyeballs, tear ducts barely able to hold back the flood. They're in love: cue the Donny Osmond music. Bleccch.
