A retired steelworker who served as a Nazi guard should be deported even though the United States granted him a visa in 1956, a federal appeals court ruled Tuesday.
Anton Geiser's work as a guard meets the type of persecutory conduct banned under the Refugee Relief Act, which was in effect when he entered the U.S., the ruling said.
Geiser, 83, did not cite his Nazi ties on his visa application, but he is not accused of lying about them. Files from the period have been lost and it is not clear what questions he was asked.
His lawyer, Adrian N. Roe, argued to the court this year that guards not deemed war criminals were sometimes allowed in by the State Department. He complained that the Justice Department, in its efforts to expel former Nazis, was revisiting decisions made a half-century ago.
But the 3rd U.S. Circuit Court, which focused on the language of the Refugee Relief Act, said Geiser should have his U.S. citizenship revoked and be deported.

No one was accused of being a War Criminal for JUST being a guard. Likely there is testimonial evidence that he was a high-ranking or particularly vicious guard...not just a schmuck who was drafted.
Many thousands of culpable, willing Nazi war criminals were never tried, due to "cold war" prerogatives (more valuable working for us than in prison) or more often bungles in paper work (or wor$e).
Just because he's old and mistakes were made 50 years ago, doesn't mean we should let off a suspected multiple murderer. If the evidence survives to legally convict him, and a court using due process has it proven to them, he should not be let off for crimes done...even a long time ago.
Facing trial doesn't mean facing conviction--and you can't tell me it's easy to convict someone on 65+ year old evidence.
PS: I have a German friend--nicest, gentlest guy you'd ever meet--whose father was convicted as a war criminal at Neurenburg. According to my friend, to his dying day he was a paranoid unreconstructed Nazi. They do still exist.

We don't prosecute them, we just throw them out, prosecution is left to wherever they end up. Or the UN in rare cases.
I don't disagree with with you, but the impetus must come from the victims, particularly the victims in the former Soviet states. I'm sorry it's not happening, I recognize the fact that the same folk may be in power, but I don't know that there's much the US can do. Unless the perpetrator are here. In which case we throw them out, as we should, and their home counties do nothing.

His illegal entry seems to be a US govt error (no evidence to say otherwise stated). From the quote below, it appears that they made quite a few of them.

One thing to keep in mind: The Hitler Youth program started in the early 20s, and was VERY popular. After Hitler it became required of all able bodied boys and girls to be a part.
Certainly this man, aged 13 when the war started, was a product of the Hitler Youth...and therefore among the most fanatical of all of the Fuhrer’s followers. He never would have been accepted in the SS if that were not the case.
I have no problem finding it plausible that a teen-aged SS guard, of that era, could be a war criminal.
Our own experience of teen-aged gang members shows that some of the younger ones—if they are raised in that environment—can be the most vicious, violent and the most psychopathic.
The Nazis were, after all, the most evil sort of gang who took over most of Europe...
Let a court in his home country figure it out—the Nazi SOB lied to get in the country—America is better than the likes of ex-SS guards.

I’m not saying he’s not a Nazi or wasn’t a Nazi. I just remember the old Germans I said hello to in the 70s and the occasional American who ran off to the White Mountains to avoid military service in WWII because they sympathized. They were Nazis themselves, I am certain.
But the world is different now. Our problems aren’t from WWII and Korean War times. Not even Nam—at least for the people who weren’t cowardly enough not to serve. This guy is one of the last of his kind and his generation. The story ends there to my way of thinking. If we deport him and bear that expense, he can go back to the old country, have a nice lake house place or a flat in Kitzingen or somewhere and not have had to pay travel costs.
