No one was accused of being a War Criminal for JUST being a guard. Likely there is testimonial evidence that he was a high-ranking or particularly vicious guard...not just a schmuck who was drafted.
Many thousands of culpable, willing Nazi war criminals were never tried, due to "cold war" prerogatives (more valuable working for us than in prison) or more often bungles in paper work (or wor$e).
Just because he's old and mistakes were made 50 years ago, doesn't mean we should let off a suspected multiple murderer. If the evidence survives to legally convict him, and a court using due process has it proven to them, he should not be let off for crimes done...even a long time ago.
Facing trial doesn't mean facing conviction--and you can't tell me it's easy to convict someone on 65+ year old evidence.
PS: I have a German friend--nicest, gentlest guy you'd ever meet--whose father was convicted as a war criminal at Neurenburg. According to my friend, to his dying day he was a paranoid unreconstructed Nazi. They do still exist.
He lied to enter this nation, he's being thrown out. This isn't a criminal issue. My guess he won't be charged with anything, anywhere, he just won't be an American anymore.
And one of them went on to become UN General Secretary.
