The ‘plastic handguns’ argument is related to a bunch of hysteria around some efforts to use advanced polymers to create handguns that could fool metal detectors. There have been some successes in making these but there are still huge safety questions.

I think that the 2nd Amendment provides citizens with the right to keep and bear arms for their protection, whether or not such arms are used by footsoldiers.

I would hope so. I hope the founders didn't want the right contingent only upon their modifying first phrase.

Well, class time for me, boys, I’ll check back in later.

Got my students pouring over a worksheet having to do with deviant behavior and crime. About 20 minutes left in the day. This thread has made for some good discussion material for the next class.

A 9-0 decision for Heller would be huge, but I just don’t see Ginsburg going that way at all given her past track record.

I hope you’re right, but I have serious doubts that the decision would be so far reaching. You are certainly right that the Miller case isn’t going to hold them back on much. Remember, though, that regarding Stevens and Ginsburg, they are pretty hung up on the notion that there must be some type of military/militia service involved, something other than Joe Blow being allowed to keep a handgun in his nightstand because he feels like it.

I predict 7-2 for individual right and against complete ban, with appropriate waffle-language to put “reasonable” restrictions off for another time.

Ironic, Bork would have had Kennedy's spot and voted to overrule Roe, but would not have an individual rights interpretation of the 2nd Amendment. Now we love that Kennedy is in the position to be the deciding vote on this issue. I have been pissed for years about that Borking, but in this one instance I am glad for it. Life can be strange indeed.

In case anyone wonders, NO, I am not saying I would trade one issue for the other. I am just pointing out how Kennedy is helping us where Bork would not have.

Breyer couldn’t quit talking about the crime statistics. He believes it is ok to infringe on a fundamental right as long as he thinks it reduces crime (whether it really does or not). He will not vote with us on this.

Sure, but I ask you to look at what they've done with abortion over the years.

Roe v Wade uses the 14th Amendment as it's justification. Nowhere in the 14th is the word abortion used. Now compare that whole debacle to the 2nd where everything is clearly spelled out. All that is left is clarification. Even such antigun and prestigious institutions as Yale School of Law have had review articles in support. I remember the title to one such: That Alarming Second Amendment came out several years ago. The liberal universities have been trying to prepare their brethren for just this sort of decision. It was inevitable.

I'll bet that all of those nominees were given to Bush in a list with political reasons for pushing them and that list was generated by some very conservative staff members. He made the nominations but I'll bet he didn't choose the initial list.
