Not only did they revisit Miller but almost every sub-conversation was making reference to it. As much as they talked about it they almost have to do something with it in the decision.

I wonder how the BATFE is handling this. If they do shoot down the Hughes Amendment, which I think they are going to do, NFA is going to be overwhelmed with form 1 applications. Even if they don’t take out the MG ban, it’s going to be challanged in court almost immediately after the decision is handed down.

I don’t envy those folks.

They were horse pistols for close quarter. Not necessarily a 'joke', but last ditch.

The saber as you mention was more in their hands for fighting, but a pistol from horseback was much easier to use than a rifle. Pistols were what cavalry carried in pommel holsters up until the size could be reduced.

You had pistol in one hand that doubled as a club after firing alongside the saber.

Just to be clear, the Court is not going to rule on any other statutes this summer other than the DC ban. Anything else is beyond the scope of the Question Presented. Its opinion might imply that other statutes are unconstitutional, but the court won’t come right out and say it. That will wait for another day, even if we’re fortunate enough to win this one.

God reward Justice Kennedy for standing up for the Constitution as well as the solid four.

Too bad we can’t look forward to replacing one of the Bolshevik left with another conservative in the next term.

If the 2nd Amendment is given away, it is time for Revolution. I say that as a Christian and family man. The government will not take away our civil rights, or the government will have gone too far.

I have to disagree. They have to deal with Miller in this case because of the strict vs. moderate application. This will directly effect 922 (o). this case will be much broader than just the DC gun ban.

I agree. It wasn’t the lawyers that kept bringing up issues outside the scope of the question at hand, it was the judges themselves. The lawyers were the ones that kept going back to the case itself. We’re gonna get a decision on much more then the question of DC’s ban on handguns.

With Dellinger admitting that under Miller machine guns were more protected than handguns, once DC loses on the handguns issue then getting back our right to own newly manufactured machine guns shouldn't be much of a stretch.

I want a P-90...

It may or may not deal with Miller. But there is no way—absolutely, positively no way—that the Court will not strike down any statute as unconstitutional except for the DC statute.

The Court is not in the business of writing sweeping rulings, particularly when those rulings would amount to a significant detour and frolic from the Question Presented to the Court.

Probably they are close to an outright panic. I fully expect some people to arrange a massacre in the NorthEast somewhere in an attempt to get the Justices back to trying to restrict fully automatic weapons.

Am I paranoid regarding this? Yes, and for damn good reason. Never trust F Troop.
