Schwarzenegger denounces 'outrageous' homeschooling ruling

(03-07) 13:37 PST SACRAMENTO -- Gov. Arnold Schwarzenegger promised today to ensure that parents have the right to homeschool their children, after a state appeals court ruling severely restricted the practice in California.

"Every California child deserves a quality education and parents should have the right to decide what's best for their children," the governor said in a statement. "Parents should not be penalized for acting in the best interests of their children's education. This outrageous ruling must be overturned by the courts and if the courts don't protect parents' rights then, as elected officials, we will."

An estimated 166,000 children are homeschooled across the state.

The ruling by the Second District Court of Appeal in Los Angeles said all children ages 6 to 18 must attend public or private school full-time until graduation from high school or be tutored at home by a credentialed teacher.

The Southern California case stemmed from a child welfare dispute involving the children of Phillip and Mary Long of Lynwood (Los Angeles County). The couple's eight children have been home-schooled by Mary Long, who holds no teaching credential. The children were also enrolled in a private school through an independent study program, which included quarterly home visits. Although the case did not involve the question of the children's truancy, the court decision broadly addressed the legality of homeschooling in California while specifically ruling that the Long family's situation violated state law.

Hey, I say give him his due when he does something right. Perhaps it might give him the incentive to do more good things. Stranger things have happened.

[Yeah, like having to pay outrageous property taxes to support failing public schools, AND have to pay to actually educate their children.]

Good for Arnold. He is very much a mixed bag (to put it gently), but I’ll applaud him in every instance he fights the good fight.

She’s burnt out, not because of the kids but all of the paperwork she has to hand into the state, leaving less time for her to teach.

That's everywhere.

I started selling life insurance in 1987. The best policy I had was a 4 page application. Today, only 20 years later, that same policy series application is 100 pages long!

Add to that al the internal stuff and it's endless. After a sale, I often say "Oh Lord, what, what have I done?"

I'm confused Dan. According to knowledgeable posters, and the California Department of Education web site, a private school, exempting public school attendance, apparently only involves the annual filing of a simple form.

All the fuss over this case of alleged child abuse, not involving education, appears much ado about nothing ... which makes the Austrian even more callus.

Apparently these parents elected to lie to the State of California, were caught and are now facing loss of their privilege to privately school two of their children at home

If it is common sense, why did the judge rule they way he did?

There are a lot of liberals who don't comprehend homeschooling. They think homeschooling parents are backward and potentially harming their children by not properly "socializing" them. In other words, homeschoolers are right-wing nuts subjecting their children to subversive indoctrination.

Judge Crosky's comments:

"California courts have held that ... parents do not have a constitutional right to homeschool their children," Justice H. Walter Croskey said in the 3-0 ruling issued on Feb. 28. "Parents have a legal duty to see to their children's schooling under the provisions of these laws."

Parents can be criminally prosecuted for failing to comply, Croskey said.

"A primary purpose of the educational system is to train school children in good citizenship, patriotism and loyalty to the state and the nation as a means of protecting the public welfare," the judge wrote, quoting from a 1961 case on a similar issue.

Home-schooled children do not make good mind-numbed robots, and Croskey is a dupe.

Right.....”certification” is the government’s way of getting a piece of the action.....look into the new “Earth Advantage” programs for new homes....where they use Energy Star appliances and Low-E windows....in Oregon, home builders have to pay $5000 for the sticker that says they used those products......Certification CAN be good....but NOT when it’s by the GOVERNMENT!!!!

You simply file a few papers and they leave you alone — no social workers, tutors, “certified teachers,” etc.

How 'bout Texas? Here, you just *do* it. You don't have to fill out forms or make a request or submit to testing.

I love this state.

I guess you haven't met the Teachers we have in California. Oh will this open a can of worms. Serious we have HOMOS, TRANSFESTITE. CHILD MOLESTORS AND JUST PLAIN STUPID. I know there are some good ones but its tough out here. Yeah I probably spelled trans wrong ,not on spell check.

Homeschoolers should rally a petition to recall this entire 3 panal court. It has been done many years ago with the Rose Bird lefty. It is time to curb the court powers .They act as if only they are the only part of the Govt. that counts.

humblegunner, I don't think you know too much about the system in question here. Homeschooled children in CA are required to use a state-approved curriculum, which they must show evidence of completing by objective testing. A credentialled teacher is just not necessary in this context.

This program was originally developed by Bill Bennett. It's an online curriculum and in many respects, a better education than I got: http://www.k12.com/

That's kind of amusing considering the legislature is now moving to teach communism in California schools.
