Michael Mukasey's prospects for confirmation as Attorney General seem to be resuscitated, thanks to the endorsements of two Democrats on the Senate Judiciary Committee. We suppose this counts as progress -- of a sort.
Judge Mukasey set off a cascade of Democratic opposition because he declined to make a pre-emptive legal ruling on "waterboarding" before he had the security clearances to review the classified evidence. Our sources confirm press reports that the CIA has only used this interrogation method against three terrorist detainees and not since 2003. Congress could have outlawed the practice at any time, but Democrats conspicuously did not take it up before it became a pretext for capsizing the Mukasey nomination.
The inquisition attracted the usual antiwar elements but also Democratic leaders like Hillary Clinton, Barack Obama and Judiciary Chairman Pat Leahy. And while the political campaign intensified, Chuck Schumer -- who suggested Mr. Mukasey's name for the AG post in the first place -- played Hamlet, refusing for days to say whether the Judge still had his support.
On Friday the New York Senator ended his indecision, noting that, while Mr. Mukasey was "not my ideal choice," he was "the best we can hope for" from President Bush. California's Dianne Feinstein also came out in favor; she reportedly made up her mind earlier in the week but waited to announce her intentions to give some cover to Mr. Schumer. That's another indication of the leftward pressure on Democrats...

Such transparency. There is no plan to reject Mukasey. The theatrics are to get headlines to deflect what is happening. There is no split in the Rat solidarity.
If the man is rejected, Ted Olsen will be appointed during the Thanksgiving recess.

All the Dems are doing is stinking up the place now, so that, when they resist Bush's national security policies later, they can say they never liked Mukasey.

Schmucky Chumer, having suggested and all but recommended Mukasey for Attorney General a few months ago, has been the usual liberal Democrat tying himself up in the usual inconsistent knots, hasn’t he?
Don’t be fooled. The RATS need a new boogey man to vilify, raise money and campaign against. That’s why they are letting him through the committee.
Of course, but they’ve developed a reputation for doing nothing, which is probably not all that good for fundraising, and certainly won’t be helpful when they try to demonize the guy they voted for.

You would thinks so, but in practice it doesn’t matter. They just claim they were misled and lied to. They do it every day. Besides, hate outweighs logic.

Why not just "recess appoint" Mukasey anyway? And for that matter, any other positions that fall vacant for the remainder of the administration?

I'm going to do my darndest to help Fred Thompson get the nomination, but no matter who gets it I'm going to do my darndest to help defeat that evil treasonous whore.
I guess it’s good that Feinstein and Schumer are giving the Senate permission to do what they need no permission whatsoever to do anyway, but it pains me to think that we are dependent on those two jackasses acting as gatekeepers to eliminate official Senate debate and and also make the vote a formality. That’s not how the process was designed.

Keeping in mind that I am but an ordinary cotten picker, Mukasey could also be appointed but Olsen would be the preferable choice.

First, you have to wait for a recess. Secondly, by intentionally short-circuiting the Senate confirmation process, you pretty much guarantee that this group of jerks will spend the next 15+ months constantly "holding hearings" and "investigating" whatever department was headed up by such an appointment.
A recess appointment is still a viable approach, but shouldn't be the first option.
