Community Sues To Oust 3-Year-Old
Child With Drug-Addict Mom Lives With Grandparents

LARGO, Fla. -- A Florida homeowners group wants 3-year-old Kimberly Broffman to take her Big Wheel and hit the road.
They've banded together to oust the toddler from their Tampa-area community, which bans residents under 18.
The child's grandparents, Judie and Jimmy Stottler, admit Kimberly's been living there in violation of homeowners' association rules for three years. They said her mother has a drug problem, and isn't capable of caring for the child.
The grandparents said they live on a fixed income and can't afford to move until they sell their house. So far, there have been no takers to buy their house, even after they lowered the $189,000 asking price by $10,000 six months ago.
They also said they can't afford to hire an attorney.
Judie Stottler supports the family with her $18,000-per year dishwashing job because Jimmy Stottler is disabled and is unable to work.
Judie Stottler's friends told the St. Petersburg Times that they are worried.
"It is so ridiculous that this has gone so far," said Keith Tinsley, a cook who works with her. "She's trying her best to sell her house. It's like they are trying to force her to put Kimberly in foster care.
"These people keep batting her down and batting her down. They're just mean."
Judie Stottler said she is scared that she wil lose her house before she is able to sell it.
"We don't have any family to take us in," Judie Stottler said.
The Lakes homeowners association filed suit to oust Kimberly last month.

I wasn’t introducing “good parent” into the discussion. If you want to nit-pick words and try to turn them into something more than they are, fine.
BTW, these people have only had their house on the market for ONE year, not THREE. It is not unusual in their area for a house to take longer than a year to sell.

Obviously, you have either reading comprehension issues or other problems. You managed to pass a bar exam? Get someone to read post 332 to you and explain it.
It’s not difficult for the homeowners association to get an attorney to draw up a bullet proof, one time exception to the rules, based on compassion. I see no harm in giving the grandparents a deadline that they have to be out by the time the child is 6 or 7. These grandparents need help!
I live in FL and am very very familiar with the rules of home owner’s associations. I’m subject to them now.

PAR35, if you track back from here to your comment on my initial post, you’ll notice how aggressive you were in attacking my credibility. If we’re to be precise, your insults were based on a misunderstanding of what I said. Reading comprehension is certainly important especially as a precursor to defamatory language.

Would this qualify the child as being handicapped? If so, the community could possibly be challenged according to discriminatory clauses part of the code cited earlier.
That probably wouldn't draw sanctions if you argued it, but I wouldn't expect it to be successful. The better argument would be to say that they waited about 3 years too long to raise the issue, and argue laches.

What I learned is that these grandparents did not purchase this home and all of the HOA rules that came with it. The wife (grandmother) inherited the home from her parents.
They do NOT allow their granddaughter to ride her Big Wheels down the streets, which would indicate that they are trying to keep a low profile until they can get their home sold.
The child isn’t even at home during the day while the grandmother works. The grandmother drops her off at day care at 8:30 a.m. and picks her up at 6:00 p.m.
The grandmother works. The grandfather is disabled with liver disease, heart problems and other health conditions.

It sure appears as if this family is trying to do the best they can do, and while they’re house is on the market, they appear to be trying to keep their granddaughter out of public view so as not to disturb the neighbors. The child isn’t even home during the day. They take her to the park to play, not outside of their home.
I hope more people come forward to help, and those that are making life even more difficult for this family need to stop and think about life’s priorities.
Adults of quality don't behave this way.
If you don't want me to respond to the comments that you have posted to me, then stop posting to me. It is unfortunate that you have judged that these people aren't "quality" adults. I'm sure there are probably people who believe that you are not a quality adult either. As a matter of fact, I'd bet money on it. LOL
BTW, just because you can’t understand the logical points I have made, doesn’t mean they don’t exist. Polls on this story reflect that you don’t have a whole lot of support for your position from your fellow Americans.
I keep remembering something about “Judge not lest ye be judged”. Wherever did I read that?

Were you expecting a "Seig Heil!" in response? Sorry, when you advocate inhuman laws, I can not call them laws for humans. Does your HOA Board have an official uniform yet?
I don’t have a HOA because I didn’t make the choice and the contract these nitwits did. I don’t know how contracts between free adults are viewed in the socialist heaven you came from but here in what was a free country a contract is a man’s word and a man should be as good as his word. That’s what I meant by quality. It’s an extension of the concept of honesty, but maybe I’m getting beyond your experience.
