But you can "cooperate" and still have strange lapses of memory. It's also another argument for having the Justice Dept. GO AFTER all of these leakers and reporters, all the time.

Ugh, the CIA demanded an investigation into the leaking of Plame's name to determine if a crime had been committed. That's why Fitzgerald got involved -- to investigate the matter. Libby committed obstruction of justice and perjury -- i.e. crimes -- when he lied to investigators. So, what Libby did was commit crimes to prevent the determination of whether the leaking of Plame's name was a crime. The CIA had to assert that Plame was covert in order for there to be an investigation in the first place. Got it?

A fews days ago, the jury asked for clarification of the Cooper charge but didn't ask a question. They sent a note repeating the charge and Judge Walton wrote back that he didn't understand what they were asking him.
The jury then did a Gilda Radner "nevermind"
Let us hope the judge sees through this travesty and does the right thing. But I'm not holding my breath.

All Libby had to do was not lie and he could not have been convicted of perjury or obstruction of justice. Libby's crime was lying to investigators. Plame status was and is irrelevant to Libby's crimes.
The whole issue of whether leaking Plame's name was a crime or not wasn't even part of this trial. If that were the issue in this trial then the facts surrounding her status would have been relevant, but for the purposes of this trial, those facts are irrelevant and always will be irrelevant
