Food for thought.

HRW is wrong about a lot of things, but this isn't one of them. The gist of the report is that racist revenge rape is universal in local and federal detentional facilities. Multiculturalism does not exist Inside; there it's survival of the fittest, and unless you are physically strong and/or backed by a racial gang of your own race, you are fair game. If you are white, you will almost certainly be targeted.

I notice a considerable amount of gloating on FR when a story about inmate rape is posted. Those tempted to gloat would be well advised to remember that it is very easy to end up in slam in the United States, even if you're 100% innocent. The next time it could be you that is on the wrong side of those bars.

Has anyone ever made a case that the incidence of rape in prison is common enough that it constitutes "cruel and unusual punishment?"

If so, I think this is a significant issue.
If not, I think this is an isolated (but sad) case.

Be careful about HRW...they have another agenda.

There, it's fixed.

I'm pretty sure the only prison violence most FReepers give a damn about is the kind carried out against ex-border guards.

Hey I don't have any sympathy for people who break the law and get thrown in prison. Having said that, this stuff makes me angry because it's one more indication that the inmates seem to be running the show. Maybe if we went back to hard labor for 14hrs a day these animals won't have the energy to engage in all the illicit behavior.

Bullies in public schools serve the same purpose as rapists in prisons -- keeping the victims aware of their helplessness.

You have a good point, my uncle is a retired CO and I have few other relatives that still work in the prison system. But don't think for one second being black means you will not get raped. He always talked about how the men that were considered by black women to be very good looking were frequent targets. Women prisons are getting very bad also, because I have heard horror stories on how some women inmates have raped other inmates by putting objects in them.

A few years back my uncle was talking about a man who was freed after serving 13 years in prison for a crime he didn't commit (DNA evidence proved his innocence) the sad part about it is he was raped in prison and contracted HIV. Just to see all those people that have been exonerated through DNA evidence is downright scary. It is a shame that so many innocent people have spent time in prison for crimes they didn't commit.

Your post addresses a subject that needs to be addressed, unless we in America consider that homosexual rape is the appropriate punishment for almost any crime that gets you prison time. Or even the appropriate result of an accusation. In my view, if that is the punishment we will administer, it needs to be part of the code.

I think a lot of folks here ought to keep in mind the phrase, "There but for the grace of God go I."

The thought of homosexual rape in prison is more than enough of a reason for me to live a clean and honest life. But you're right that the innocent do go to prison and it is also possible for someone to do something stupid with a car or whatever and end up in jail.

I'm not sure why murder and rape are now considered lesser crimes than they were when I was a kid, but that's the world we live in. I believe that rapists and child molesters should have their genitalia removed. The punishment should fit the crime.

Prison is not just for criminals. This is a real problem. I have a friend who did time and he said that in the Iowa prison he was in there was no rape or harassment at all.

To all the idiots who think innocent people don't get tossed in jail or prison, sometimes for long periods of time, I have one word for you: NIFONG

Sheesh, it's hard to believe that any freepers could be this dense. I'd expect such utter lack of thought and real-world knowledge out of a moonbat crowd, but not a bunch of freepers!!!

I don't think I would survive in prison. I'm slim and have an effeminate build. So with regards to what happens in prison, I have one rule I follow in life: Don't go looking for trouble. Its served me well in keeping out of those kinds of places.

I have always stated that a prisoner has no rights except the right not to be raped while incarcerated.

We have to realise that these animals who perform these rapes are less than human.

These people who rape these other prisoners do not consider themselves as homosexuals. They are just animals who dont care what they have sex with. If there were other animals around they would have sex with them. These are the people that Democrats want to give the vote to.

This is an abomination. As I stated before . television, weight lifting basketball,a law library, a prisoner isnt entitled to any of these IMO. But a prisoner is entitled to serve his time without being molested either individually or in gangs. If the guards cant stop it then they should lock down the prison until they can. Male rape is a killing offense as far as I am concerned, any man who kills a person who raped him would not be convicted by me.

Prison rape is a scandal. Politicians do not act on this because there is little political hay to be made from telling constituents that they are "experts in prison rape."

I used to be in a prison ministry band.

If I ever found myself at risk of going to prison, I would consider living on the street in Mexico City, unable to speak spanish, to be a better fate.

If you get my drift...

Everyone knows that this goes on. It is not stopped. Therefore the authorities consent to it.
The courts do not explicitely sentence anyone to 5 years of rape in prison. However it is an unavoidable consequence of being in prison. Therefore the courts sentence people to rape in prison and consent to it.

If indeed rape in prison is the intention and purpose of sentencing, as a few posters' comments indicate, then it must be put into the law explicitly. To do what is done now is cowardly and the entire criminal justice system is complicit.

Don't break the law.

This guy was a thrice-convicted drunk driver. If you make the decision to break the law, you risk going to prison... with all its inherent dangers.

Certainly no one wants prison rape or any other assault to occur, but you lost a loved one to one of these victims, it is hard to work up sympathy for them.
