What I can't get out of my mind is that the radio traffic from that night was erased. I am sure the DPD expressed much doubt about her story over their radios that night with various officers chiming in with what they know of her. It was erased because corrupt judge Stephen would not order it preserved immediately.
Do you know what day they released that audiotape?
I think nobody, not Professor Johnson, not Bill Anderson, John in Carolina not me, not anyone has been able to see everything in this case. And anyone who has seen it all probably can not internalize it all.
Heck her medical records the defense got have not yet been seen that I know of. I know every time I think I have seen it all in this case some outrage from the past that I missed crops up.
SirJohnBarleycorn has already explained what he actually said, but I would add that the fact something is unconstitutional certainly *does* mean it constitutes a civil rights violation for section 1983 purposes. In fact, it is a civil rights violation of the highest and most pernicious form, because unlike "rights" granted by statute, our constitutional rights are forever enshrined as the organic law of the republic unless and until the constitution itself is amended by the consent of the governed (or, as more often occurs, is interpreted otherwise by a majority of the justices of the U.S. Supreme Court).
Indeed, as I argued in a prior post to you two, any indictment obtained on the basis of an unconstitutionally (and intentionally) suggestive lineup most certainly would constitute a federal constitutional violation. It is regrettable and unfortunate that statutory enactments might be considered to be the only source of our "civil rights."
I believe Howlin was referring to Officer Shelton who in the Kroger lot said something about someone going by and checking on the "young uns?" Is that right?
I know that particular comment has sparked much interest about how familiar the law was with Mangum and her kids or if she was somehow highly connected.
Now that I have read this transcript, I am wondering where the part about Dave Evans and the mustache comment was. I took notes while I was reading though it, and I couldn't find that anywhere, although there is one guy she says she recognizes him about 90%. It was image 3 on this transcript. However, I also noticed that it's missing p. 4 but it has p. 3 duplicated, so that is probably where the mix-up is. Anyway, thanks for the transcript link.

Here is one thing you both are missing; at the point in the case where he directed them to do that photo lineup, he is not SUPPOSE to be directing the case.
He is suppose to wait for the police to bring the case to him.
He took this case over and therefore he got what he wanted.
Funny, I feel that I have recently reread that in just the last day or so, but not on FR. Probably on a DIW or LS link. Lord, it could really be anywhere, I have been all over the web lately, and I haven't bookmarked these things the way I used to in the past. It is a curious thing about Mangum and her familiarity with the police department. It certainly appears that someone there knew things about her from earlier than just this incident.

I would think that Duke has liability issues, as well. It was Duke U that fired the Lacrosse coach and in cancelling the season, slandered the team.
As to Nifong, it would make me feel really good if he ended up homeless and unemployable...and, generally, I don't ever feel that vindictive...even when it's called for.

I do too. I smell at least one lawsuit here, judging by the statements of the parents. And they deserve it. In addition, Duke owned the property where the incident occured at the time of the incident.
