IIRC They don't have to host the files. There are a number of forums related to DOS, abandonware, etc. which prohibit the posting of links to copyrighted software, etc.
Whether they can get into trouble for simply having a link to warez, booglet, etc. I don't know. I do know they delete such posts.

Not according to the writer of "Path to 9/11". On Hannity's Fri. show he (the writer) said that NO ONE had been shown the second part.
