Class Action Lawsuit Against The NY Times
Vanity | June 30, 2006 | expatcanuck

Posted on 06/30/2006 2:34:50 PM PDT by ExpatCanuck

Forgive me if I posted this incorrectly. I want to hear from those with enough knowledge of the law to determine if a class action lawsuit against the NY Times, on behalf of the American people (or someone more specific if that can help the case) is viable, and from all fellow conservatives to define what the grounds for the suit could be? There has got to be some way to deal with these treasonous dirt bags that they understand. Being a regular lurker at DU, I can say with confidence that the irony that is lost on the left, is that if their perception of America were true, they would already be either dead or incarcerated for saying some of the things they say.

The only class I could think of that would be potentially viable is family members/victims of a terrorist attack made possible because of (e.g., financed) their disclosures.

I have nothing to do with class-action suits, but I don't think that one would even get filed - we have no leg to stand on. First, you'd have to prove harm, and it is arguably true that no harm has YET occurred from the Slimes' action. Second, you'd have to prove proximate cause. Since you are not dealing with a force of Nature, there is not a direct link between the disgustingly treasonous activity of the Slimes and any terrorist incident...in between would be a terrorist or 20, who carried out the incident without being forced to do so or goaded into doing so by the Slimes.

Nice thought, but its back to the drawing board.

Based on what I know, -admiteddly very little-- most crimes, do not have a private cause of action, (there are some that do). I can't think of any civil violations that they have committed, any even if there were, in order to sue the NYT you would have to show that you were damaged somehow.

You'd have to find the most activist Judge ever to get something this goofy off the starting line.

Yes, I doubt anyone will be able to sue the ny times based on a hypothetical that it would help our enemies do harm to the united states population. Something more concrete, sure.

Intentional infliction of emotional distress is a tortious act.

INTENTIONAL INFLICTION OF EMOTIONAL DISTRESS

The elements of a prima facie case for the tort of intentional infliction of emotional distress are:

(1) outrageous conduct by the defendant;

(2) the defendant's intention of causing or reckless disregard of the probability of causing emotional distress;

(3) the plaintiff's suffering severe or extreme emotional distress; and

(4) actual and proximate causation of the emotional distress by the defendant's outrageous conduct. (Alcorn v. Anbro Engineering, Inc (1970) 2 Cal.3d 493, 497-498

EMOTIONAL DISTRESS-DEFINED

The term "emotional distress" means mental distress, mental suffering or mental anguish. It includes all highly unpleasant mental reactions, such as fright, nervousness, grief, anxiety, worry, mortification, shock, humiliation and indignity, as well as physical pain.

I thought a civil suit might be the way to go but after talking to a friend, a conservative judge, I learned there would be a slim chance of the case ever being heard. Tony Snow, Bush press secretary, was on O'Reilly the other night and he inferred that the administration is trying to find the leakers and prosecute them but then said, "I don't want to tip my hand." He said the Treasury Dept. would have to ask the Justice Dept. to go after the leakers. This might entail putting editors and reporters under oath and the threat of jail if they refuse to disclose their sources.

Actually I'm surprised there hasn't been a shareholders' suit about the Time's sharp decline in market value.

I hope you don't mind me posting this in your thread,But I don't think we should for get this either.Thanks!

am contacting the many great Americans who have shown an interest in my book, The Third Terrorist: The Middle East Connection to the Oklahoma City Bombing. Please sign the following petition to initiate a legitimate federal grand jury investigation into the travesty of justice surrounding the 1995 heartland massacre.

Sign petition for OKC federal grand jury:
http://www.ipetitions.com/petition/okc_bombing/

Congressman Dana Rohrabacher desires to hold hearings to explore the "foreign connection" to the Oklahoma bombing. However, I believe the proposed congressional inquiry is nothing more than a sham. The reasons for my concerns are outlined in the articles listed below:

Jayna Davis claims Rohrabacher request for hearings just 'a sham'

I have posted on other threads the same thought. I would think that if the officers of a company allow their personal biases to override their concerns for the stock holders and overall well being of the company, then it would be actionable.

Just for the record; You can file a class action suit on ANYTHING! Doesn`t mean it will win, or will even be considered (such as thrown out) but the press alone will be well worth it..IMO

According to Yahoo...83% of the outstanding shares of the NYT are held by Mutual funds and Institutional Investors...I am pretty sure that if we all contacted our investment advisors and demanded that they discontinue any association with the TIMES...word would get around Wall Street pretty quickly that it is a bad egg. Even the threat of thousands of people pulling out of mutual funds that carried the stock would cause a huge ripple. It would have to be carried out by action of course, but no fund manager is willing to take the risk if we can get this on FOX. Ideas anyone?

Actually I'm surprised there hasn't been a shareholders' suit about the Time's sharp decline in market value.

Good point. Has the earmarks of another Enron. In this case we are not talking electrical power, we are talking political power. The Times has lied numerous times in an effort to over inflate the value of a specific political power. They have also violated numerous (national security} laws while performing unethical operations.

By the time that case gets to court many of the players will already be in Gitmo. All we need to do now is to follow the money. I got a great song for these traitors to hum while they are 'vacationing' in Cuba. It goes like this,

'This is how, life should be !'.
