"I think the case is taking on lots of water and the Prosecutor is quite frankly out of his depth."

Oh, he's in his depth alright. It's called "treading water."

I heard exactly the opposite. I heard Rove was indicted yesterday and that the news will break Monday or soon after. Just rumors.

This new "lawyer" fad of charging someone with a trumped up, bogus charge and then "getting" them for "perjury" and "obstrustion of justice" is getting REALLY old. Our so-called judicial system is definitely out of control. This crap needs to be looked at and fixed.

The DUmmies are having multiple orgasms about Rove being indicted today. It's being published as fact, and I find nothing in FR or even the MSM to confirm Rove's indictment.

I have to wonder if the DUmmies live in a parallel universe. This whole thing is a cartoon, and anyone of any sense would have dismissed it long ago.

No harm, no foul or words to that effect. Particularly since there seems to have been neither harm nor foul.

I await with bait on my breath the indictment of Karl Rove.

Hey DUmmies, bite this! No Fitzmas for you.

Bush was wrong from the gitgo to allow the Justice Department to default to a special prosecutor in this case. If the Democrats are in power, Craig Livingstone can commit up toward a thousand felonies in the basement - and be punished only by being fired by nobody, since he was apparently hired by nobody.

If the Republicans are in power and allow a special prosecutor, then allofa sudden spitting on the sidewalk is a capital offense. The Administration should have just told the arrogant journalists that they do not get to pick the Attorney General, and that is that.

he has said he has no intention of calling Wilson to the stand as his witness. He has said clearly that he does not stand by Wilson’s credibility

But the defense can call him and Plame as a hostile witness if they want to and ask him embracing questions as to who he/she told and when.

Fitzgerald also wants to offer in redacted form 5 other articles: the May 6, 2003, NYT article by Kristof; ...

snip---

As to the first three articles, Wilson was the admitted or obvious source. Plame may as well have been a source for at least the Kristof piece.

snip --

What specific reasons are offered for presenting such prejudicial material to the jury?

Context “for evidence of conversations concerning Mr. Wilson’s wife” is claimed for the Kristof article – in which Wilson’s name and his wife’s are never mentioned.

From Kristof May 6, article.

I'm told by a person involved in the Niger caper that more than a year ago the vice president's office asked for an investigation of the uranium deal, so a former U.S. ambassador to Africa was dispatched to Niger. In February 2002, according to someone present at the meetings, that envoy reported to the C.I.A. and State Department that the information was unequivocally wrong and that the documents had been forged. b>

If Plame was either Kristof's source defined as the "person involved in the Niger caper" or "someone present at the meetings" Kristof knew Plame's identity in early May '03.

I don't see how Fitz could introduce that article without someone to verify it's authenticity.

I hope Kristof is called to the stand and asked point blank who the sources were. Then Wilson/Plame can be called to testify who they told (aside from Kristof).

I noticed about 5 hours ago on MSNBC that the reporter-ette made a big deal about Fitz and these hand written notes by Cheney.
Nowhere in her story did she mention that the notes Cheney had on a story did not have anyone by name written on there.
So, with NO NAME on the notes (particularly Plame's name), what does this prove, except for the fact the White House was concerned about disinformation regarding the war hitting the press.

Fitz I hear is also thinking about a political run as a Governor somewhere. If so, he should be getting out of this now and not later. Too political for my taste without evidence.

Bottom line is that Plame was NOT under cover covert at the time of these stories, and Libby had nothing to lie about or protect.
There is no reason to be going after Libby except for political reasons and a book deal down the line IMO.

This is a very important article, made even more so because the author is an attorney. Thank you for posting it. I want to call attention to one of the author's most telling paragraphs:

I’d say from the discovery proceedings to date, the Prosecution cannot and will not show that Plame was “classified,” that it cannot and will not show that disclosure of her identity caused any harm, that the person who did do that has not and will not be charged, that it has yet to show even potential harm, and that it is a far way from showing that Libby had the slightest motive to lie. And that the stench of selective prosecution is unmistakable.

"I think the case is taking on lots of water and the Prosecutor is quite frankly out of his depth."

Its beginning to look like the Fitzgerald is not only listing, but that the November storms are early. It is hard to see that Fitzgerald is anything but a petty partisan with nothing but smoke and mirrors. It is hard to believe that his case is this flimsy, but there seems to be no other there, there.

The legend lives on from the DU on down
On the media they called 'Gotcha Gumee'
The lake, it is said, never gives up her dead
When the skies of November turn gloomy
With a load of BS twenty thousand times more
Than the Patrick Fitzgerald weighed empty.
The story was not true t’was a bone that was chewed
When the gales of November came early.

The ship was the pride of the liberal side
Coming back from some CIA junket
As the big stories go, it was bigger than most
With Ambassador lying well seasoned
Concluding some terms with yellowcake firms
When they left fully loaded for Niger
And later that night when the ship's bell rang
Could it be the ill wind they'd been feelin'?
The wind in the wires made a tattle-tale sound
And truth broke over the railing
And every man knew, as the captain did too,
T'was the witch of November come stealin'.
The dawn came late and the mint tea had to wait
When the Gales of November came slashin'.
When afternoon came it was freezin' rain
In the face of a hurricane west wind.
When suppertime came, the old cook came on deck sayin'.
Fellas, it's too rough to indict ya.
At Seven P.M. a main hatchway caved in, he said
Fellas, it's been good t'know ya
The captain wired in he had water comin' in
And the good ship and crew was in peril.
And later that night when his lights went outta sight
Came the wreck of the Patrick Fitzgerald.
Does any one know where the love of God goes
When the waves turn the minutes to hours?
The searches all say they'd have made it a crime
If they'd only been indicting a Clinton.
He might have split up or he might have capsized;
May have broke deep and took water.
And all that remains is the faces and the names
Of the wives and the sons and the daughters.
Lake Huron rolls, Superior sings
In the rooms of her ice-water mansion.
Old Michigan steams like a young man's dreams;
The islands and bays are for sportsmen.
And farther below Lake Ontario
Takes in what Lake Erie can send her,
And the iron boats go as the mariners all know
With the Gales of November remembered.
In a musty old hall in Detroit they prayed,
In the Maritime Sailors' Cathedral.
The church bell chimed till it rang twenty-nine times
For each count of the Patrick Fitzgerald.
The legend lives on from the DU on down
On the media they call 'Gotcha Gumee'.
Superior, they said, never gives up her dead
When the gales of November come early!
