Rush Limbaugh Reaches Settlement with Prosecutors - Charge Will Be Dismissed In 18 Months

Rush Limbaugh's attorney has issued a statement announcing a settlement of the Florida prosecutor's investigation into alleged doctor shopping by Rush Limbaugh.

Details have been read by Sean Hannity and Rush Limbaugh. Basically, the charge of doctor shopping is dismissed, with some conditions.

In response to media and other inquiries, Roy Black, Rush Limbaugh's attorney, released the following statement today concerning a settlement agreement with the Palm Beach County State Attorney's Office to end the investigation of Mr. Limbaugh:

"I am pleased to announce that the State Attorney's Office and Mr. Limbaugh have reached an agreement whereby a single count charge of doctor shopping filed today by the State Attorney will be dismissed in 18 months. As a primary condition of the dismissal, Mr. Limbaugh must continue to seek treatment from the doctor he has seen for the past two and one half years. This is the same doctor under whose care Mr. Limbaugh has remained free of his addiction without relapse.

"Mr. Limbaugh and I have maintained from the start that there was no doctor shopping, and we continue to hold this position. Accordingly, we filed today with the Court a plea of 'Not Guilty' to the charge filed by the State.

"As part of this agreement, Mr. Limbaugh also has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation. The agreement also provides that he must refrain from violating the law during this 18 months, must pay $30 per month for the cost of "supervision" and comply with other similar provisions of the agreement.

"Mr. Limbaugh had intended to remain in treatment. Thus, we believe the outcome for him personally will be much as if he had fought the charge and won."

The actions taken today are as follows:

-- The State Attorney has filed a single charge of doctor shopping with the Court. The charge is being held in abeyance under the terms of an agreement between the State and Mr. Limbaugh.

-- Mr. Limbaugh has filed a plea of "Not Guilty" with the Court.

The formal agreement between Mr. Limbaugh and the State Attorney will be filed with the Court on Monday. The terms of the agreement are substantively as follows:

-- Mr. Limbaugh will continue in treatment with the doctor he has seen for the past two and one half years.

-- After Mr. Limbaugh completes an additional 18 months of treatment, the State Attorney has agreed to drop the charge.

-- Mr. Limbaugh has agreed to make a $30,000 payment to the State of Florida to defray the public cost of the investigation.

Money is great and Rush has worked hard for it. But I think he has links to some of the great minds in the conservative movement not just because he is worth a few bucks but because he is the leader of the movement.

Having been in radio myself since 1976 I know you don't get 13-15 million listeners for no reason at all. There is Rush and then everyone else. Rush has probably forgotten more about broadcasting than many of those on the air today think they know. He knows all the little ins and outs and it shows day after day.

When Rush is on the air he never takes it for granted and is always "broadcasting" while others are rambling on or just talking to hear themselves talk. This guy really knows his stuff.

Most talk show hosts on the air today are all measured against his performance. Rush sets the standards for modern broadcasting. That alone say a lot.

will never forget the day I found Rush. I love him for that and I always will.

I actually owe Rush a huge debt of gratitude. I was one of those who was downsized in the mid 90's. Do you remember the week-long pep talk he gave to all of us? He convinced me I could do more than I thought I could. Soooo, I did it !...and have been doing it sucessfully for 10 years...in the business I love. He's got a special place in my heart forever.

But .. according to the Palm Beach papers - RUSH DID NOT COP A PLEA - HE ANSWERED A WARRANT - NOT GUILTY.

How you can come up with he copped a plea by pleading guilty to a lesser charge I don't know. Please get your facts straight before saying Rush plead guilty to a lesser charge. Your statement is totally false.

A lawyer friend sums it up: “Not guilty, no admission of guilt. He was processed voluntarily. The prosecutor did not bring the case to a jury and in 18 months the charge (doctor shopping) is dropped. The prosecutor has made a charge. It will not be tried. In 18 months it will be dropped.

"Here's the distinction I make with Rush. The root cause of his addiction was his attempt (with doctor's help) to alleviate severe back pain. He wasn't snorting cocaine at parties or shooting up. He wasn't dealing. If I cut him any slack, it's because of his back pain because I suffer from some amount of back pain, myself, and it's very debilitating. At this point, I am not taking any prescriptions for it, only over-the-counter pain relievers."

I too suffer from the same kind of back pain as Rush, although mine is inoperable. I take the same medication as Rush, and I have to purposely, and physically restrain myself from taking more medication than prescribed. It would be very easy to step over that line, and be pain free all the time. I am dependent on this medication. That is much different than being addicted. I venture to say Rush's problem was closer to dependency than addiction.
That being said, Sloth commented that the numbers worked out to 3 pills every 6 hours. That is A LOT of this medication. I currently take 3 pills per day. If his were the 40mg version, that works out to the equivalence of 12 10mg Percocets every 6 hours. I know I could never take that amount. It would kill me, and I'm not a small guy. However size doesn't matter in this case, as I met a young, 100lb girl abusing Oxycontin (chewing, snorting) and she had a 800 mg a day habit. I don't know how she was alive. This medication ain't cheap. My 1 month prescription with out insurance would be about $450. On the street I've heard it going for as much as $5 a mg. Do the math on that.
Rush will be in my Prayers tonight. He faces satan himself, being in that much pain, and not being able to get help for it.
All of you a$$holes (not Purccival, or Sloth, this is for some others like cloud8)that are glad he's gone through this, remember that one day you'll have to answer. Your punishment might be the pain he endures everyday. Let's see how glib you are then.

The Judge was just on BOR calling it a huge victory for Rush. He said it was a totally political persecution by an active Gore supporter.

She "knows" because she spoke to Rush personally about it and gets the latest, best information on his legal situation. How else could she speak so authoritatively in every post?

Oh, wait, she said she "knows" because she heard some lawyer, whose name she doesn't recall, calling in with that hot tip to a cable news show.

Judge Napolitano on BOR just announced the prosecutor in Palm Bch. was a big Kerry supporter and has been after Rush forever on this bogus charge.

Napolitano said it was a huge victory for Rush especially since he has to do his rehab with the doctor who supposedly overprescirbed him to begin with.

BOR was trying to poo-poo Rush's victory and spin it as a bad day for Rush. Funny, aren't they on at the same time? I would love the see BOR's numbers, can you say tank.

Every person on this thread who sees fit to jump to conclusions about Rush should think VERY carefully about this case.

Whether you think so or not, Rush represents the pinnacle of conservative thought. He has millions of listeners each week, and the mere thought of bringing him down is what every liberal prosecutor dreams.

Rush made this go away in the least painful way possible. There was no finding of guilt.
