SENATOR SESSIONS ON SECURING AMERICA'S BORDERS ACT

Mr. President, I thank Senator Leahy, ranking member on the Judiciary Committee.

I have received just this afternoon in my office some disturbing news in the form of correspondence from the Congressional Budget Office. It suggests a number of areas where the amendment we are talking about here today, No. 3424, the immigration so-called compromise, violates our budget and the rules of the Senate.

Let me read from the correspondence we have received. This is something, as you know, Mr. President, as a member of the Judiciary Committee, that we never discussed at all. It is not a matter we spent any time at all discussing as we moved forward with legislation which ultimately cleared that committee and came to the floor — legislation which I thought was not good legislation and which I opposed, and so did the Senator from Texas, who just relinquished the Chair. We didn't discuss the financial impact of the legislation before us.

House Votes to Allow Military to Assist in Border Security

WASHINGTON, May 12, 2006 – The U.S. House of Representatives voted yesterday to allow military forces to be used in border-security operations under certain circumstances.

In a 252-171 vote, House members agreed on an amendment to the Sonny Montgomery National Defense Authorization Act for Fiscal Year 2007. Representatives also voted yesterday to name the bill after Montgomery, a retired congressman and tireless veterans advocate. Montgomery died today at age 85.

The act gives authority to the Defense Department to assign military members to assist Homeland Security organizations in preventing the entry of terrorists, drug traffickers and illegal aliens into the United States and in inspecting cargo, vehicles and aircraft entering the United States to prevent weapons of mass destruction or other terrorist or drug trafficking items from entering the country.

The act specifies that such a move must be made at the request of the secretary of Homeland Security, who must certify that the action "is necessary to respond to a threat to national security posed by the entry into the United States of terrorists, drug traffickers, or illegal aliens."

Pentagon spokesman Bryan Whitman stressed that the military already has been helping other government agencies in some border-security functions, namely surveillance with unmanned aerial vehicles. "I think it's important to understand that the United States military does provide some assistance to the states currently," he said.

Governors in some border states use National Guard servicemembers in border-security missions, as well.

Whitman said it's important to remember that governors have authority to mobilize their National Guard forces as they see fit as long as they pay for the mobilization from within state budgets.

The Posse Comitatus Act of 1878 largely forbids the U.S. military from becoming involved in domestic law-enforcement actions. The Coast Guard and National Guard troops under the control of state governors are excluded from the act, however.

"This county has always had a certain level of discomfort & with military doing things that are law enforcement-type activities," a senior official said on background.

Critics of such military use point to the case of 18-year-old Ezequiel Hernandez, who was shot and killed by a U.S. Marine patrol near the Rio Grande River at Redford, Texas, in 1997. The Marines said Hernandez fired at them, and the corporal who pulled the trigger was not charged with a crime. But the case brought about widespread attention to and debate on the role the U.S. military plays in border enforcement. Similar issues have been raised about the military's role within the United States since the terrorist attacks of Sept. 11, 2001.

The federal government also can pay for governors to mobilize their National Guard forces in the case of national emergencies. This mechanism was used during recovery efforts for Hurricane Katrina. Activated Guard forces remained under their governors' operational control, but federal funds were used to pay for the operation.

In addition, National Guard forces can be federalized then used in the same manner as active-duty forces.

Press reports today state that Assistant Defense Secretary for Homeland Defense Paul McHale has asked defense leaders to devise options for use of military forces in border-enforcement activities. Defense officials today did not specifically confirm this, but said such a move would be consistent with contingency planning that goes on every day in the Pentagon.

"This is a building that develops options, & develops potential courses of action," the official said. "This is not a decision the Defense Department would make, though. Border security (and) policing is not the primary role or mission of the United States military."

Language in the bill refers to allowing military members to assist Homeland Security assets in preventing terrorists from entering the United States. Officials have long recognized that illegal trafficking in people and weapons through Latin America poses a threat to the United States.

Rumsfeld and his Central American counterparts discussed this issue at a conference in Miami in October. All in attendance agreed that porous borders to the south can contribute to international terrorism.

"Drug traffickers, smugglers, hostage takers, terrorists, violent gangs: These are threats that are serious," Rumsfeld said at the conference Oct. 12.

Whitman said today that the United States stresses to South and Central American neighbors the importance of border security. Ungoverned spaces and available funding for illicit activities certainly can have a relationship with terrorism, he said. "That's why we should be concerned," he said.

Whitman also said that today's meeting between Defense Secretary Donald H. Rumsfeld and Mexican National Defense Secretary Gen. Gerardo Ricardo Vega is "unrelated to any current speculation that I see in current press reporting."

"This has been on the schedule for quite some time," he said.

There are some in the U.S. Congress who have tried repeatedly to pass a simple amendment to the Immigration and Nationality Act (8 U.S.C. 1102).

That same bill, has been re-introduced in the 109th Congress as H. R. 698. The express purpose of the bill is "to deny automatic citizenship at birth to children born in the United States to parents who are not citizens or permanent resident aliens."(29)

Not only do the anchorkids get everything paid for for most of their lives BUT they collect SSI.

Watched the first half of the MM Rally on Real Player and I am so pissed!

America needs to hear them screaming in Spanish God only knows what they are saying? If when caught, human being flesh smugglers do long jail time, so then, shouldn't the leaders of La Raza, MecHa, Aztlan, the Communist Party U.S.A., and any U.S. officials like Hillary Clinton, Ted Kennedy, and L.A. Mayor Antonio Villagrosa etc., that spoke to, and gave aid/comfort, also get equal treatment under the law. Or is there a double standard once illegals are a few miles in our Southern Borders?

If there is in fact a double standard, then all jailed "Mexican Coyotes," should be set free to ply their trade, otherwise, there should be some high profile public hangings? I would like to see the latter!

WASHINGTON (AP) - A little-known spy agency that analyzes imagery taken from the skies has been spending significantly more time watching U.S. soil.

In an era when other intelligence agencies try to hide those operations, the director of the National Geospatial-Intelligence Agency, retired Air Force Lt. Gen. James Clapper, is proud of that domestic mission.

He said the work the agency did after hurricanes Rita and Katrina was the best he'd seen an intelligence agency do in his 42 years in the spy business.

"This was kind of a direct payback to the taxpayers for the investment made in this agency over the years, even though in its original design it was intended for foreign intelligence purposes," Clapper said in a Thursday interview with The Associated Press.

Geospatial intelligence is the science of combining imagery, such as satellite pictures, to physically depict features or activities happening anywhere on the planet. A part of the Defense Department, the NGA usually operates unnoticed to provide information on nuclear sites, terror camps, troop movements or natural disasters.

After last year's hurricanes, the agency had an unusually public face. It set up mobile command centers that sprung out of the backs of Humvees and provided imagery for rescuers and hurricane victims who wanted to know the condition of their homes. Victims would provide their street address and the NGA would provide a satellite photo of their property. In one way or another, some 900 agency officials were involved.

Spy agencies historically avoided domestic operations out of concern for Pentagon regulations and Reagan-era executive order, known as 12333, that restricted intelligence collection on American citizens and companies. Its budget, like all intelligence agencies, is classified.

On Clapper's watch of the last five years, his agency has found ways to expand its mission to help prepare security at Super Bowls and political conventions or deal with natural disasters, such as hurricanes and forest fires.

With help, the agency can also zoom in. Its officials cooperate with private groups, such as hotel security, to get access to footage of a lobby or ballroom. That video can then be linked with mapping and graphical data to help secure events or take action, if a hostage situation or other catastrophe happens.

Privacy advocates wonder how much the agency picks up - and stores. Many are increasingly skeptical of intelligence agencies with recent revelations about the Bush administration's surveillance on phone calls and e-mails.

Among the government's most closely guarded secrets, the quality of pictures NGA receives from classified satellites is believed to far exceed the one-meter resolution available commercially. That means they can take a satellite "snapshot" from high above the atmosphere that is crisply detailed down to one meter level, which is 3.3 feet.

Clapper says his agency only does big pictures, so concerns about using the NGA's foreign intelligence apparatus at home doesn't apply.

"We are not trying to examine an individual dwelling, for example, because what our mission is normally going to be is looking at large areas," he said. "It doesn't really affect or threaten anyone's privacy or civil liberties when you are looking at a large collective area."

When asked what additional powers he'd ask Congress for, he said, "I wouldn't."

His agency also handles its historic mission: regional threats, such as Iran and North Korea; terrorist hideouts; and tracking drug trade. "Everything and everybody has to be some place," he said.

He considers his brand of intelligence a chess match. "There are sophisticated nation states that have a good understanding of our surveillance capabilities," including Iran, he said. "What we have to do is counter that" by taking advantage of anomalies or sending spy planes and satellites over more frequently.

Adversaries who hide their most important facilities underground is a trend the agency has to work at, he said.

NGA was once a stepchild of the intelligence community. But Clapper said it has come into its own and become an equal partner with the other spy agencies, such as the CIA.

Experience-wise, the agency is among the youngest of the spy agencies. About 40 percent of the agency's analyst have been hired in the last five years.

"They are very inexperienced, and that's just fine. They don't have any baggage," said Clapper, who retires next month as the longest serving agency director. "The people that we are getting now are bright, computer literate. ... That is not something I lie awake and worry about."

False: Americans will perform any legal job necessary to support themselves and their families. Linda Swopes, who operates Complete Employment Services in Mobile AL said: �I assure you it is not true that Americans don't want to work. We had been told that 270 jobs might be available, and we could have filled every one of them with men from this area, most of whom lost their jobs because of the hurricane.� The identified Mexican illegal immigrant workers were simply willing to work for less money than were US citizens.

Claim: �Illegal immigrants help the American economy.�

False: Illegal immigrants to the US cost the country at least $10 billion more than they contribute to the economy. The CIS (Center for Immigration Studies) advises that if amnesty is put into place, these costs to the American economy (and the American taxpayer) will triple. The average illegal immigrant family uses $2,700/year more in services than it pays in taxes. In 2002, this amounted to a $10.4 billion drain on the federal budget. Some of the greatest federal costs included: Medicaid ($2.5 billion); treatment for the uninsured ($2.2 billion); food assistance programs ($1.9 billion); the federal prison and court systems ($1.6 billion); and federal aid to schools ($1.4 billion).

Claim: �Illegal immigrants are just hard-working people who want jobs.�

False: The US Justice Department reported that in 2003, alone, 270,000 illegal immigrants had served prison time. The Federation for American Immigration Reform reports: �In March 2000, Congress made public Department of Justice statistics showing that, over the previous five years, the INS had released over 35,000 criminal aliens instead of deporting them. Over 11,000 of those released went on to commit serious crimes, over 1,800 of which were violent ones; including 98 homicides, 142 sexual assaults, and 44 kidnappings. In 2001, thanks to a decision by the Supreme Court, the INS was forced to release into our society over 3,000 criminal aliens who collectively had been convicted of 125 homicides, 387 sex offenses, and 772 assault charges.�

The Federal Bureau of Prisons estimates that fully one-third of current prison populations are comprised of non-citizen illegals.

Islamic terrorists, including Mexicans with terrorist ties, have entered and are continuing to enter the US via our unsecured borders.

The violent MS-13 Salvadoran gangs have illegally immigrated across the US-Mexico border. MS-13 has also vowed to kill local police, Border Patrol agents and US citizen-members of the Minutemen project, within the US.

Claim: �Illegal aliens help keep cost of goods down�

Misleading and false: Although marketplace agricultural products are estimated to be somewhat lower than they would be if US citizens were performing the jobs illegals carry out, the cost to US taxpayers in free services to illegals vastly outweighs any savings to the US consumer. And illegal immigrants are no longer solely operating in agriculture but, have expanded out into multiple industries. In Los Angeles, 49-year old construction worker Michael Williams (jobless for 3 months) said outside of a Home Depot: �You have a lot of illegal aliens here. It takes food off the table.� The spread of illegals into other industries is increasing geometrically.

False: Civil rights pertain ONLY to citizens. The Merriam-Webster online Dictionary defines civil-rights as: �The nonpolitical rights of a citizen; especially: the rights of personal liberty guaranteed to U.S. citizens by the 13th and 14th amendments to the Constitution and by acts of Congress.� If one is not a citizen of the country, civil rights do not apply.

False: First and foremost, by the very nature of illegal immigrants being in the country �illegally�, they are neither following nor abiding by US law. Also, illegal immigrants are increasingly using bogus or stolen Social Security numbers. The crime of Identity Fraud being affected by illegal immigrants has become a growing and sever problem. Rep. J.D. False: Although many illegals are demanding US citizenship, and to be given special consideration ahead of those who have applied legally, a marked number of Hispanics do not want it. But, they do demand the �same rights� as US citizens. Many Hispanic groups, including (but not limited to) MEChA, the Mexica Movement and LULAC, are supporting and working toward the re-conquest (�reconquista�) of the United States. These groups are, also, becoming increasingly militant.

Misleading: Many are hard working. However, in Los Angeles, alone, 95 percent of all outstanding warrants for homicide (which total 1,200 to 1,500) target illegal aliens. Up to two-thirds of all fugitive felony warrants (17,000) are for illegal aliens. �A confidential California Department of Justice study reported in 1995 that 60 percent of the 20,000-strong 18th Street Gang in southern California is illegal.�

Claim: �The claim that illegal immigrants drain US services is a myth�

False: From the L.A. Times and Rice University�s Professor Donald Huddle: �Less than 2% of illegal aliens are picking our crops but 29% are on welfare.� And as far back as 1997, according to Huddle, the cost of illegal immigration to the American taxpayer was a net (after subtracting taxes immigrants pay) $69 Billion.

Claim: �Illegals do not drive down US workers� wages�

False: As already presented, illegal immigrants from Mexico are working for far less money than US citizen workers and on a regular basis. An 18 April 2006 article in WSJ by Professor of Economics and Social Policy at Harvard University George J. Borjas (�For a Few Dollars Less�) quotes Paul Samuelson: ��an increase in supply [of workers] will, other things being equal, tend to depress wage rates." Although Samuelson�s conclusions were, for years, disputed, recently they have been proving to be accurate.

Borjas writes: �My Harvard colleague Lawrence Katz and I recently examined the impact of the 1980-2000 immigrant influx (and particularly Mexican-origin immigration) for U.S. wages. The results are that, in the short run -- holding all other things equal -- immigration lowered the wage of native workers, particularly of those workers with the least education. The wage fell by 3% for the average worker and by 8% for high school dropouts.� He further concludes: �These effects imply sizable reductions in annual earnings for low-skill workers. In 2000, the typical high school dropout earned $25,000, so that immigration reduced his earnings by $1,200, even after all capital adjustments take place. Mr. Katz and I also examined how much was due to Mexican immigration. We calculated what the wage effects would have been had there been no Mexican immigration between 1980 and 2000. We found that Mexican immigration, which is predominantly low-skill, accounts for all of the adverse impact of immigration on low-skill natives.� In NRO (National Review Online), Borjas continues with: �In fact, immigration may have depressed the wages of low-skilled workers by 5 to 8 percentage points.�
