Tribe doesn't want to go on record.I'm here to testify against Alito, but I don't want to say so. It would not be in my own self-interest.

It's this little statistic [only been two Justices appointed by Democrats] that brought out the passion of those opposed to Miers. There were a host of reasons to be opposed to Miers - and I emphasize the "reason" part of the word "reasons."
OTOH, most of the support for the Miers nomination was bottomed out on trust in President Bush, not on reasoned analysis of the system, or on reasoned review of the record in order to project Miers' likely judicial philosophy into the future.

"No, just a serious lack of opportunites for nomination. Since 1968 (nearly 40 years), there have only been two Justices appointed by Democrats, and both of those were done under Clinton."
Any yet, we barely have a balance towards strict constructionists on the court today. Can you imagine how liberal the court would be if Dems had more opportunities to select justices?

I still don't know WHY Tribe is there...does he? He's against the confirmation of Alito, but figures indirect testimony will be more persuasive and less open to counter attack.
