Day 4: Hearing Resumes
This morning, Senators will question Judge Alito during a third round. They will then go into a closed session, to review the FBI background investigation on the Supreme Court nominee. Outside witnesses may be called to testify this afternoon, as well as the American Bar Association, to discuss its recommendations.

I appreciate your showing how it is the political system that gives us, the citizens, the framework of our remarkable freedom and ability to participate in government. I get very upset when I hear people complain about how political everything has become (Sean Hannity does it all the time). It was always supposed to be political. A more accurate way to put it is how politicians have become too beholden to their own political party at the expense of their constituents.

The ABA testimony is subtly slanted in phrasing if one doesn't know the phraseology. The testimony is very fair, because the ABA approaches the matter as guilty unless proven otherwise.
Leahy is playing on this, assuming that recusal was necessary for fair justice - but in fact recusal was not necessary for fair justice. Alito recused in order to avoid an appearance of potential bias. Note that appearance of bias is in the viewers mind, and if the viewr sees the word "Vanguard" in a case, they may jump to the wrong conclusion.
Again, here is the "errors were made" comment, but you have to understand the nature of the error to fairly appreciate the testimony.
Speed limit is 65, your policy is to drive 60. Is it a mistake to go 62? You betcha it is against your policy, but it's certainly well within objective fairness.
I'm willing to bet one of those witnesses will testify that Judge Alito is a racist, sexist, bigot, homophobe and he will destroy civil rights, etc.

Back to CAP! Leahy asks ABA if this was just pandering to the Reagan administration.
Steve Tober of the ABA: "We interviewed over 300 witnesses and have come to the conclusion that he (Alito) brings no bias to his decision making."
